She wants to sponsor me ASAP

What process will i go through; and how long will this take?

Before you get ahead of yourself answer this question: Did you overstay a visa? Or did you Enter without Inspection (border hop).

If the latter then it'll be really hard to even get the application considered.

hhmmm interesting.......does the 18 1/2 matter for marriage if you entered the US illegaly??
Dude maybe you should just get adopted by a USC...i know somebody that did that way.

My understanding is that the process depends on if you entered without inspection or not.

If you entered without inspection you file a bunch of papers, pay a bunch of fees, you have to show some reason that being separated from you spouse for the 10 year bar would be an extreme hardship on your citizen spouse. Extreme hardship has to be more extreme than the usual reasons of not wanting to be separated/or having your spouse move to your home country. Eventually you get an appointment and have to leave the country for interviews and medical bans and hopefully a waiver of the inadmissibility bar ( but they can always reject your reasons, and then you are stuck there ). If you are from Mexico you have to go to Juarez.

I believe that the process is somewhat similar if you are on a visa overstay -- but you can complete the process in the U.S. and the bars might be different.

From what I know if she sponsors you, they'll ask you to leave the country and apply from your home country. Which most likely means that they'll deny your application and you won't be able to enter the country again.

If you are under 18 1/2 you should consider leaving and coming back on a fiance visa. Check with an attorney first though of course, and be very careful - if your fiance changes their mind you could be in an even worse situation.

Adoption only works if you are under 16, easier if you overstayed a Visa
