Sponsorship question.

Ok so my dad's brother is a USC & he sponsored my father on Mid April of 2001. I know that the process take about 10-14 yrs. How long will it take for me to change my status. I know that my dad will change his status first but how long will it take for me to change my status since i was wondering which process would be faster just in case the DA Does not pass.

where you mentioned in the petition application?

If you where, then you would be grandfathered under 245i.

Well... as of right now, if the DA passes go into the DA, I would not even ask the question of which one would be faster that does not matter, what matters is that you attain any form of legalized status, I would not risk being out of status for too long, besides, being undocumented as an adult sucks big time.

Yes I believe i am mentioned in the petition. so what does it mean that I am Grandfathered under 245i. What does this mean. Can you please try to explain it to me since this is my 2nd option right next to marriage if the DA Does not PASS

Use the search function to find more detailed information on what 245i is.

A basic response is that if your father attains USC status after you turn 21 he would be able to petition for you and you would not have to leave the country and activate the 10 year ban because you were grandfathered under 245i.

If you were not covered under 245i you would have to leave the country and it would activate the 10 year ban, and all because the immigration law states that only children are immediate family members to USC parents, once you turn 21 you become the son/daughter and thus no longer considered an immediate relative (a technicality that affects me).

Well I am 18.5 at the moment so does it matter if i turn 21 & my father is still not a USC Sorry but i am Still a bit confused. Am I lucky that i am covered under the 245i. Can you try to explain this to me sorry If I am having a bit of difficulty the part i dont understand is

You are lucky to be covered under 245i and if your fathered petitioned you, you would not have to leave the country

I am not covered under 245i ... therefore I am not lucky, if my parents petitioned me I would have to leave the country activating the 10 year ban.
