Fiancé visa

My Husband's cousin asked me about fiancé visas and I don't really know the answer to her question. Her boyfriend was brought here at 16 so he doesn't qualify for DREAM and they are trying to fix his status. She asked me if he could just go back to mexico and then she could apply for a fiancé visa for him. She has a passport and has gone to mexico in the past year so she feels they will be able to show that they met then and will be able to get his visa approved. Isn't there an inspection when you enter Mexico though? I've heard there is this paper you have to sign stating you were in the country illegally if you don't have proper documentation when you enter Mexico.

Why will anybody sign any document stating tht they have been in the country illegally if they have never been caught. If he doesn't have any record here, he can go back (the way he came in) and then apply thru legal way, i guess.

Well he went to high school, isn't that record enough for him to be found out? I guess the thing I don't understand is how would immigration officials be able to tell one person from another without a social security number or any other form of identification? I know there are more people in the world with my exact name then just me.
