Hey, you guys might remember me asking about some Amtrak trips.
Well I've been able to delay my trip from New York City to Louisiana to March 4th.
I'm mailing my immigration package this friday, february 11th, and since I'm married to a USC I'm mailing my i-130 and i-845 together.
I know I will get a case number around a month after, but since my trip is a bit before that, would it be safe to travel? Can I arrested if anything were to happen?

Typically,there is a turn around of about 2-3 weeks from what I've seen in getting at least a receipt that the paperwork has been filed and the biometrics is about ~2 weeks after,at least in my case anyway.

I don't think it is a good idea doing anything until you have at least the I-797 notice of action indicating you have a pending I-485.

You can still be arrested considering you only filed an application...nothing more.The key issue here is what is likely vs. what isn't.The likelihood of being arrested by any ICE or CBP officer with a Notice of Action showcasing pending residency is VERY unlikely because it would be a waist of enforcement resources,why arrest someone when they'll be legal in a few months and then have the ability to sue us later !

Don't go until you have the NOA's. After that, as long as you don't break the law, you're safe.

Thank you guys.
I've been postponing this trip for a month now, I'm not really sure if I can do it for longer. But I'll see what I can come up with. I spoke to one of my lawyer's assistant, and she told me by march 4th all I will have is Biometrics.
Approximately how long does a notice of action take?

This is my timeline.

10/25/10 - Sent in package to Chicago Lockbox
11/06/10 - Received receipts.
11/08/10 - Received biometrics appointment for 12/01/10 and
12/01/10 - Did biometrics.
01/24/11 - They sent EAD and final interview letter for March 1st.


I also did have an RFE so it would have been faster. So from the moment you send in the checks, should be 5 to 10 days.

It took a while for me to get the NOA (longer than usual), maybe 2-3 weeks. But the entire process from beginning to end only took 3 months.
