Plan tries to counter Republican initiative to criminalize undocumented stay


In a new attempt to get a benefit for millions of illegal immigrants, Sen. Bob Menendez (New Jersey) will present on Wednesday a comprehensive immigration reform bill similar to a project aired in September last year.

The plan is co-sponsored by Democratic Senators Harry Reid also (Nevada and leader of the Senate), Patrick Leahy (Vermont) and Richard Durbin (Illinois).

The new project appears a week after Republicans in both houses presented an initiative that, among other recommendations, proposes to criminalize undocumented stay and enforce the registration of companies to the federal E-Verify, to check the immigration status workers.

Organizations defending the rights of immigrants Menendez acknowledged the effort at a time when everything seems to indicate that there will be a bipartisan agreement to ensure prior approval.

The 2010 plan

According to the newspaper La Opinion in Los Angeles, California, Menendez's proposal is similar to a version submitted in late September last year along with Senator Leahy, which included a regulated pathway to legalization for millions of undocumented immigrants without criminal records .

The plan Menendez, Leahy also required that people register with the government (through the Department of Homeland Security-DHS-), speak English and pay fines: a $ 500 check and another $ 1000 for regularization of their permanence and acquire permanent residency or green card (green).

In the Senate, Democrats have 51 seats plus the support of two independent seats. The project needs 60 backs (of 100) for approval.

Obama called attention to

"In the absence of a frank discussion in Congress about how to fix the immigration laws that are inconsistent, are broken and are inhumane, Senator Menendez introduced a bill that seeks to inject some sanity to a rancorous debate, malicious and false" said Angelica Salas, executive director of the Coalition for Humane Immigrant Rights of Los Angeles (CHIRLA). "The proposal is an opportunity for President Barack Obama fulfills his promise to reform immigration laws and for the Senate to counteract anti-immigrant wave in Congress, especially in the House."

Salas added that "the proposal is a golden opportunity for Democrats in the House and Senate show that they are on the side of justice, the American dream and the humane treatment of immigrants."

Menendez has worked in all efforts to pass comprehensive immigration reform since the debates of 2006.

"We applaud Senator Menendez to keep the flame of hope and remind the American people that only through a significant change to the system of immigration laws, we can reach a reasonable point that benefits us all," said executive director of CHIRLA.

He added: "The measures that only focus on the implementation of existing laws such as the deportations, detentions, arrests and mass dismissals at home under the cover of night, succeeded in destroying millions of families and countless communities, but not have brought us closer to a sustainable response. And while the resource intensity of this Administration has focused on deporting immigrants honest, hardworking, tough questions that still makes the American people remain unanswered. "

During fiscal years 2009 and 2010 (the first part of President Obama), DHS has deported more than 800 000 illegal immigrants. The government says most of those removed had criminal records, but CHIRLA warns that six to seven out of 10 Enia no serious criminal record constituted a threat to U.S. security.

Frank Sharry, executive director of America's Voice Initiative said that Menendez is "sharp contrast" with the Republican proposal Smith.

The draft 2010

In September 2010, Senators Leahy and Menendez surrendered to the Immigration Sub Committee of the powerful Senate Judiciary Committee a comprehensive immigration reform project based on a large component of national security and included a regulated legalization process that will benefit millions of illegal immigrants.

The proposal recommended increasing the number of police agencies in charge of DHS border and control illegal immigration. It also called for streamlining the operations of the liaison office of border communities and review the system of entry visas to the United States.

The plan suggested sanction as aggravated felony fraud passports and visas, and recommended revising the policy on asylum and refugees.

Regarding the issue of controlling illegal immigration, Menendez and Leahy asked to review and extend the Employment Verification System (E-Verify) by the Bureau of Citizenship and Immigration Services (USCIS), a mechanism that collates data identification of foreign workers with the DHS databases, Social Security (SSA), FBI and the immigration service.

To that end, states that in a period not exceeding five years all companies that hire foreign personnel are enrolled in the federal program, designed as part of security policies after the terrorist attacks of September 11, 2001.

Path to citizenship

On the chapter of legalization, the project-Leahy, 2010 Menendez favored those who were undocumented in the United States when approved and promulgated the law, who should meet the current eligibility requirements.

He noted that the background of the immigrants who qualify for the program would be reviewed thoroughly and, while awaiting approval from the authorities of the DHS, may have access to temporary work permit, in addition to a fine of $ 1,000 have remained undocumented the country.

Wow, good freaking news everyone. Now, I don't know how the Dream Act hearing which will occur on Tuesday fits into all of this. Someone enlighten me if you know because Democratic senators seem like they lack coordination on the issue.

Maybe, Democrats might try CIR first. If that fails, then they might go after DA and E-verify???????

Yeah. It's risky. Well, if Democrats are going to push for CIR first, they should move as fast as possible because the timeframe would be more narrow to advance the DA and E-Verify (and possibly Ag Jobs) in a serious manner if CIR were to fail.
