getting other visas

Hi everyone, I'm new here but I've been lurking for a bit.

Lately, I've just been getting pretty pessimistic about Dream Act passing in the near future so I've made up my mind to finish my bachelor's degree here and then move back to the Philippines where I can probably get a really good job. At this point, I'm already getting the 10 year ban because I'll be 20 next year... but I want to apply for visas elsewhere.

I basically wanna use my home country as a jumping pad and travel the world. My questions is would I even be able to get visas to those places when they see my overstay? Do they even see my overstay?

i remember reading a thread in this site where someone applied to Canada and he believe that he was rejected because he flat out came out honest about his overstay in his application.

if i were you, i would lie and say that i did not overstay. there is literally no way that they would do a background check on you. Immigration center is not FBI and they don't have the right to check your personal information in other country (probably don't have the time to do so either).

but the key is to find out what field that you have to go into to get a visa. I'm pretty sure if you major in psychology or meteorology, you can't get any visa as opposed to some field that has to do with technology and engineering. the specifics regarding the fields are in the immigration website in the particular country..

mine was rejected in Canada explicitly because of my status in the US. I came clean and hoped my honest disclosure would reflect through in me telling them I wouldn't stay there. Canada asks for copies of previous visas from other countries and I was afraid that post-911 US agencies would be sharing info with Canadian authorities (hijackers came thru there after all). I know another guy here applied thru his country and basically just crossed his fingers and 'forgot' to include the required visa paperwork for the US.

I've heard of folk in our situations coming clean to US immigration and basically adjusting to F1 visas, but this is really up to the individual (if they want to risk it or not). Our status in the states really puts a wrench in applying to other countries so perhaps looking at other less exposing options may be the ticket.

Personally, if you do it in your home country, I at least think you could have a shot. Maybe fudge a document or two. But if you apply within the US, of course they are gonna ask what you are doing there.

After 9/11, a lot of countries, particularly the ones tourists would want to visit, are looking closer at who is entering and sharing information with other countries.

You may cross your fingers and hope no one finds out about you stating something wrong in one of those forms and conveniently forgetting to include something, but doing so would be a federal crime. Now, in the US, being charged of a felony carries a sentence of at least 1 year, but they will feed you, clothe you and keep you in relatively clean facilities, being charged of a felony in another country, it might not be as pleasant.

Unfortunately, when any one gives you a tourist visa, they want to make sure you are only a tourist, and having on your record that you were deported for overstaying a visa, or where undocumented in a different country will raise a huge red flag and give reason to not allow entry.

The other issue, the 10 year ban, well, that probably only exists if you have legal basis to enter the country, if there is no one to petition for you, the chances are that even after the 10 year ban, they might not grant you a visa to enter the country legally.

Such is the mess of our circumstances and what we are trying to change.

stating that you studied in the US and lived there in your visa paperwork, regardless of where you live presently means you must present evidence of Student Visa. You're still fucked...
