My wife just got a new job and she needs to fill out her w-4.

Now...where it asks for her marital status, there is a note stating: "If married, but legally separated, or spouse is a nonresident alien, select single status."

Although I'm "in the process," as of now, I'm still undocumented. Should she select single?

Thanks for helping...!

All the W-4 does is tell your employer how much taxes to withhold by giving a point for every dependent that would lower her taxes. From what I know, she can't claim you as a dependent and I'm not sure if she can file a joint income tax statement since you're a non-resident type person so she would be paying the higher single person tax rate.

Short story, yes, she should put in single. If they happen to take out too much taxes, or you end up getting a green card during the year and can file jointly, you can very easily change that and get a refund at the end of the year.

disclaimer, not meant to be legal advice, do your own research etc. etc.
