Not eligible?

He came here in the US legally about 2002? So then today he mentioned that he left the US about a year ago and went to canada so he can renew his visa.

Then i told him that you must be in the country for 5 consecutive years meaning for june 15 2007, june 15, 2012 . So my question is, is he eligible still ? Regardless that he left the country to go to canada to renew his visa ?

If he renewed his visa isn't he legal?

Also it doesn't say anywhere on the language of the policy whether "leaves" are allowed, maybe if your friend was only gone for a few days it won't matter. Either call the USCIS hotline or wait it out until they come out with more specific language in 60 days.

Renew his visa? Is he on tourist or student visa? This doesn't make any sense.

Anyway, he won't eligible since he left the US during the 5 consecutive years. If he went back to Canada to renew his visa, they must have his record of leaving the states.

No this new memo will only benefit those who are UNDOCUMENTED and fall under the requirements. The whole point of this is to halt deportation for certain individuals so if your friend is not subject to deportation then he cannot apply.
