Subjected to removal

I have been in removal proceeding for 5 1/2 years due to a really complex immigration case. For my master hearing last year, I had gotten a final order of removal by voluntary departure, but I field for an appeal in which I am still waiting on the verdict, its been almost a year since I filed.
Do you think I am still eligible for deferred action?
I also have no criminal offenses.

I think you will be ok.

Did you apply for deferred action for the first 4.5 years while you were waiting for the final verdict? I think this is the only thing that could really affect your case.

I believe my lawyer did. I am gonna have to contact her on the technicalities. I am just filled with apprehension towards my eligibility.

I'm the same except our appeal was denied and was given voluntary departure and that's all i ever knew about. I probably have an order of deportation but i should be ok with deferred action (from what i've read)

I'm assuming you guys are in the US and thus never left.I'm pretty sure the procedure would be if Discretionary powers are used an Final order of Deportation can be closed 'Without Prejudice' if the Agency in question ask an Immigration judge to do so along with your own legal representative of course.
