Can I be considered for deferred action even if I do not meet the guidelines to be considered for deferred action for childhood arrivals?
This process is only for individuals who meet the specific guidelines announced by the Secretary. Other individuals may, on a case-by-case basis, request deferred action from USCIS or ICE in certain circumstances, consistent with longstanding practice

Seems like there is hope for people that don't qualify by the requirements.

BUT, maybe not for those 31+

How old must I be in order to be considered for deferred action under this process?

In all instances, you cannot be the age of 31 or older as of June 15, 2012 to be considered for deferred action for childhood arrivals.

People 16+ would not qualify for the original version DREAM ACT

People 31+ would under the retroactive provision

So who is the case by case going to apply? if not for those that don't qualify.

And, this is not the Dream Act.

If 16, 17, and 18 year olds were excluded in the original DREAM ACTs then it wouldn't make sense to include them in the "dumbed down" version one.

But I could be wrong.

This is not the Dream Act.....there is a possibility based on the case by case.

No, what they mean with this question is something I've said in several other threads. Deferred action as a process has existed for decades -- that's what's still available to you if you don't qualify for DACA. DACA itself is a type of deferred action, but deferred action is just not only for DACA.

However, receiving deferred action through other means is probably as difficult as getting asylum granted, so it's not anything easy or simple to obtain.
