I don't think you need passport photos.

I doubt many people have looked at this but if you go the i-765 instructions, page 6, Required Documentation, and section 2. B, I quote it says

"If you are filing under the (c)(33) category, additional documentation beyond what you submit under Question 3 on page 3 of the Filing Instructions for Form I-821D (this is referring to the section that asks what documents you need to prove identity), Consideration of Deferred Action for Childhood Arrivals, is not required.

I would have posted a picture of that section but I'm not sure how to do that.

It makes sense that you wouldn't need to prove your identity further, as that is the basis of question 3 on Form I-821D instructions.

IF you didn't take the time to research it all, long story short, you have already proved your identity through form I-821D and therefore submitting passport photos is not necessary. Mind you, people that submit I-765 do not usually do it along with a form that asks for their identity, but our case is an exception.

Yes, you have to send your photo it says so in section 2. c. it does not omit anyone. inface, sections 2 b has nothing to do with the photos.

I was reading through the forum and saw that many people were really worried about passport photos and I just didn't understand how some people had missed that.

So I did the logical thing any man would do. I made an account just for that purpose :P.

Someone had brought it up before. Notice you yourself preface your post with "I don't think". We all think here and there, yet we're not sure. The instructions are there in front of us, and we still think we don't have to send them. Personally, I opted for spending the $8, and sending it in the photos, rather than taking the risk.

I'm pretty sure the process will be very streamlined for those who apply after 3-4 months. Everyone will know exactly what those ambigious lines mean, what kind of evidence got them approved, what kind of evidence got them an RFE, etc. This includes the lawyers as well, who are just as unsure on certain points.

Photographs are not documentation within this context. Section C clearly states that you must (they even emphasized it) two identical color photographs. I highly doubt the guide would contradict itself.

I don't see why it would say you don't need additional documentation beyond what you used to satisfy question 3 of page 3 on I-821D instruction. If the documentation it is talking about on the I-821D form is mainly ID's, birth records w/ pictures, etc. , that would mean that this documentation is referencing photographs.

Actually, this was a good thread you started, however section 2 c clearly does not omit anyone from not sending the photos, it says you MUST and the word must bolded.

However, and this does not include DACA, when I e-filed my last work permit and my dad, we didn't have to send a photos, the photo was taken at biometric. my mome did hers through a lawyer and send by mail and had to send a photo. (my dad and i really didn't want to pay the lawyers a fee for filling and we ended up saving like $20 e-filing because we didn't have to take the photos). Since we DACA applicant can't e-file we have to send photos.
