As many of you may know, California passed a legislation that would give DACA beneficiaries the privilege to obtain a CA. state license.

but what im wondering is can we get the driver's license with just the Deferred Action approval or do we have to wait until we get the EAD?

Quote:
SEC. 3. Section 12801.6 is added to the
Vehicle Code , to read:
12801.6. (a) Any federal document demonstrating favorable action
by the federal government for acceptance of a person into the
deferred action for childhood arrivals program
shall satisfy the
requirements of Section 12801.5.
(b) The department may issue an original driver's license to the
person who submits proof of presence in the United States as
authorized under federal law pursuant to subdivision (a) and either a
social security account number or ineligibility for a social
security account number.
http://www.leginfo.ca.gov/pub/11-12/...d_sen_v93.html

if this is the case, it would be alot easier for us to have our DL now while we wait for our EAD approval.

mmmm need to google this as the word acceptance has a broad meaning...
cause the requirements for id/dl before this law stated that you needed your original I-797 APPROVED letter stating adjustment to ur legal status wether its perm or temporary (basically when we get approved or rejected) without a ssn. (well you'll have to provide the ssn in future as in the application you click a box that says you will do it and u waiver the ssn for now)

http://www.dmv.ca.gov/dl/dl_info.htm#BDLP

I-797 approved petition part ;p

yea i know that but check this out though.

satisfactory proof that his or her presence in the United States is
authorized under federal law, but who is not eligible for a social
security account number
, is eligible to receive an original driver's
license if he or she meets all other qualifications for licensure.

(b)
(c) Notwithstanding any other law, the social security
account number collected on a driver's license application shall not
be displayed on the driver's license including, but not limited to,
inclusion on a magnetic tape or strip used to store data on the
license.

hmm i sure do hope that we can get our license with just the Deferred action approval.
Im not claiming anything that this is what the bill says. This is just my understanding of the bill. If one is more knowledgeable on this issue please correct me if im wrong.

hence my first sentence! if it means what i think it means. We can get our id (then dl) with our I-797 "acceptance" letter. And next ? would be when will it take into affect!
and seriously ive tried to get and id/dl before with previous pettition in process but they asked me for my 1-94 or alien number etc.. so i know for fact that we can waive the ssn for, with the I-797 aproved petition letter.

Approved Deferred Action I-797 > Take to Social Security office > Social Security office gives you an official letter stating you're not eligible for a SS number because you don't have a work permit > Take the letter from the SS office to the DMV + Approved Deferred Action I-797 > Get your state ID/License.

Gov. Jerry Brown is supposedly to sign the bill today but not a word of it yet. I am not sure when will this take in effect.

Honestly, that is very plausible as we'll have a deferred action status when we get approved. If worse comes to worse and that is the only document and this is the case for Cali would-be-drivers, that would cut the worry in half! (sorta)

actually for Cali ppl it would be like:
I-797 approved petition (work permit) letter arrives, go to dmv take out id/dl, waived the ssn part, no EAD needed yet. But you have to provide them in future, as part of the waiver you sign.
or wait til u get ur ssn and EAD And get your id/dl.

with this law it would mean we can get our id/dl with our I-797c acceptance letter? sign the ssn waiver part, and perhaps when we get our ssn and EAD provide it to dmv to justify the waiver. Thats if im reading the part "acceptance into DACA" part right. So i guess im gonna tune and find info bout it
