Form I-821D -16a question -helping a friend with form

I have a friend that enter with a B2 visa and remembers filling an Arrival Record (I-94) but he lost that record.

16.a. do you have an arrival/departure record(I-94)?
Does he check yes or no?

I think immigration probably has the record, you should probably explain or seek an attorney.

According to a YouTube video posted from a paralegal you're supposed to put yes and when it asks you for the number you put lost.

I stated my source so you can make the decision on weather or not to go with it. Maybe someone has a better source w better info?

I have the same case. I checked NO, and then explained it was lost on Part 7: Additional information. So far my application is moving forward. I'm waiting for Biometrics appointment.

Even though it's lost you can get the arrival date form his old passport. I believe it's also possible to pay and request a copy of the I-94. But research this to make sure it's true.


Assuming that's true, I would put yes, then explain that it's lost in the more info section. If they request more evidence then you could file to get a copy of the i-94.

To request an I-94 replacement go here.

It costs $330 and the average time to complete it is 2.5 months.

If they request for more evidence about your arrival you might have to use that replacement service.

I am uncertain if the DACA processors would check the system themselves for the copy of your i-94.

But remember, the didn't say it's required. You just need to prove you came before age 16, and that you have been here the last 5 years. Your school, medical, or some other type of records might accom0mplish all of that.

If in serious doubt ask a lawyer how to proceed.

Request for evidence are timed, so if a person does get one they could set the deadline for 60 days or so. The amount of time it takes to get a replacement I-94 is between 60-75 days. I have the same problem my passport has some damage. For that very reason I have decided to get the I-94.


If anyone else is having the same problem with one of your entry stamps, I suggest getting the replacement I-94 or its equivalent and then sending the DACA packet with that information, rather than wait for a RFE.
