Hey guys, not sure if you guys can help me out with this, but here goes. Back in August 2007 my father, a legal US resident at that time, filed for my sponsorship. My priority date is Aug 2007. I received my approval of the I-130 on Aug of 2009. This past February my father became a US Citizen and refiled my case so i am now in the F1 Visa Category. Within a few days of him filing, i received a letter from the National Visa center requesting i fill out some forms so i can begin my Consulate processing. I submitted one of the forms, paid the $88 for the Affidavit of Support DS3032 and received "Payment Receipts for IV Case". I later realized that this case was going to be processed in my consulate country (Not in the US). I then received a email stating i pay $404 for the Visa Application Processing form. I have yet to paid this fee since i don't want this case to be processed in my consulate country, but in the U.S. After sending NVC an email stating i want to adjust status in the U.S. they sent me the following response
"We received notification of the principal applicant's intent to adjust
to permanent resident status in the United States with the Department of
Homeland Security's Office of U.S. Citizenship and Immigration Services
(USCIS). We will hold the petition at the NVC until we are notified by
USCIS to return the petition to them"

This was back in March and i have not contacted the NVC again. I contacted USCIS and they said i need to wait until my Priority date is reached. Right now they are dealing with cases from Oct 2005, so it looks like it will be another 2 yrs of waiting until Priority date of Aug 2007 is reached.

When i first sent the payment to NVC they sent me this repsonse "f a period of one year passes from the last date of contact with the
NVC (by telephone, mail, or email), all submitted fees and documents
will expire. If this occurs, your fees will need to be repaid and
documents will need to be resubmitted in order to continue the
immigration process." I am worried that after the one year mark of no action, will my case be canceled? Should i be looking into further action or just wait until my priority date is reached.

Hmmm i think you have to wait until your priority date is reached, maybe you got ahead of yourself. I'll be going thru the same processing in a couple of years so i'm not sure i can advise you yet.... did you file yourself? For my parents' work sponsored petition they waited, didn't know they could have gotten work permits and just ended up receiving their residence when their priority date was up (same time they paid fees and all). Yea i only paid the fees for NVC cuz they sent me an email, but once i heard i would have to go back to my consulate country for processing, i quickly put a stop to it.

Yes My sister did all the paper work when my father filed for me. So hopefully in 2 years i will get my residency. This Deferred action will work in the mean time for the next 2 yrs

I read somewhere that emailing, checking for status with them, anything that made them look at your case reset the clock on the 'abandonment' issue.
You might want to google this to keep your case alive.

Yes, you have to check your case. Call them, e-mail them and just ask how the process is going blah blah but if they see that you are not keepin up with it it will " die". I remember reading it on website.

I am curious about your case, I am assuming you aged out when your father received his permanent residence, correct? And when he filed for you, were you protected under the CSPA to stay in the U.S. to await your case?

We should've done what your family did for you 5 years ago for my brother who unfortunately aged out when my mom and I received our green cards, now she'll file an F1 petition for him since she is becoming a U.S. citizen in a few months. In any case, yeah I read about the "abandoned" cases as well, you should contact them about your case ASAP. Best of luck bro!

My dad filed for me when i was 24 years old when he was a permanent resident. Then refiled when he became a US citizen this yr (I was 29). You can still apply if you are over 21, but it takes longer. http://www.uscis.gov/portal/site/usc...00082ca60aRCRD
If i was under 21 i would have recieved everything in like 6 months =/. its been 5 plus years so far

I sent an email to NVC to verify the "Abandonment" issue if i do not contact them after 1 yr. I will let you know their response once they reply back
