Hello, i am trying to apply for DACA but when i was 15 i made a very poor choice and i got caught selling Marijuana to a friend. Went to court and the Judge granted me Deferred Entry Of Judgement. I just had to complete one year of informal probation and had to stay out of trouble. I completed the program after a year and got my case dismissed. That record is now expunged. I am 27 years old now. I have been running around from lawyer to lawyer seeking counsel and they don't seem to know weather i should apply or not. My question is, has anyone with a similar case or know of someone with a similar case tried applying? also if anyone knows of a good lawyer in Northern California that would have good experience in these types of cases? I would like to know if there is hope for me. Thank you for your time.

I'm now 23. When I was 19 I got caught with possession of marijuana. I never plead guilty & the case was dismissed. I got approved for my deferred action. If your a minor after 5 years whatever is on your record as a minor. It would be completely erased. Being that your 27 now, & it was dismissed & you don't have any other convictions on your record as an adult you should be fine, I never had an attorney I did all my paperwork and filling on my own. Give it a shot. What's the worst that can happen?

Just apply. What's the worst that could happen? Keep in mind, nobody has been denied so far.

i have tickets that i havent paid from back in 2006 when i was in middle school, for MIP i dont have a warrant for my arrest for those yet and hopefully never cause i don't plan on paying them. i know it's not as severe as your's but you didn't get arrested right? and maybe because you weren't trying to sell a large amount of mj.

but hey i know someone who was in a federal prison for i guess conspiracy, because he was found living in a house were large amounts of cocaine and mj were kept, and he got approved for DACA, & they let him out.

The guidelines state one of the qualifications is:
Quote:
7. Have not been convicted of a felony, significant misdemeanor, three or more other misdemeanors, and do not otherwise pose a threat to national security or public safety.
What I'd advise you to find out is what your criminal record says about your incident, is its considered a felony or a misdemeanor. The second line of that guideline is extremely vague but it basically means to ask whether or not your a criminal or a terrorist. Take a look at the I-821D form in the section about this particular issue and you should get an idea of what they asking for.

Do yourself a favor and read the FAQ National Security and Public Safety section on the USCIS website. It clarifies some of it.
