So I do have a misdemeanor (possession of marijuana). I have already received conflicting information from two lawyers. One told me that I could apply because USCIS made it clear what crimes they didnt want. From USCIS guidelines:

"Regardless of the sentence imposed, is an offense of domestic violence; sexual abuse or exploitation; burglary; unlawful possession or use of a firearm; drug distribution or trafficking; or, driving under the influence; or,
If not an offense listed above, is one for which the individual was sentenced to time in custody of more than 90 days. The sentence must involve time to be served in custody, and therefore does not include a suspended sentence." ( I was on probation aka suspended sentence)

Another told me that I shouldnt apply because possession of marijuana is a deportable offense and that i should try to get my charges annulled. which most likely will be a long wait and money.

So which lawyer should I listen to? I dont know what to do.

I noticed there are more than 1000 rejections already and my bet is that those are all people with some kind of record.

Rejections don't mean denials. It means people did not file their paperwork correctly. If you fit all the other stuff I think you will be fine. I think someone else in the forum applied with a Marijuana conviction. I forget the name of that thread.

If you go to page 3 ---------4Justice had a misdemeanor marijuana charge at 17. He was just approved. You should contact him.

The only difference is that he was a minor when it happened to him. USCIS isnt supposed to use juvenile records against you. I was 19 when it happened to me..

How old are you now? Do you have any other criminal record? If you have all the other stuff and just that on your record I say apply. I think you might have to send them some information on them. Maybe the lawyer that said you needed to clear your record wanted some extra money. What type of lawyers were they? private or nonprofit organizations? Did you pay them for the consultation?
