Form I-130- petition for alien relative

My sister recently got her citizenship. She wants to petition for me. I live with her in the US. Do i have to wait those 10+ years that people abroad have to wait for??

YES.

I am currently waiting, however I am not covered under section 245i which at the moment once my priority date comes up I will have to leave the country.

However, if any kind of immigration reform passes, and there is a path to citizenship, the 245i would have to be extended because I don't think or hope they want all the 12Million + to go back to their countries and receive their Greencard there.

my sister petitioned for my mom....it was really fast and she didnt have to leave....but I dunno what happens if you're sisters...because my sister cant do it for me yet. I remember the lawyer said shed have to wait a couple of years to be able to give it to me or something...

F4 category is different. Currently you have to leave, but I know there is a way you can got to court and try to fight it. Also, it is helpful to have close relatives (parents, brothers, sisters, sons, daugthers)

I wonder what's faster: a sibling that's a citizen asking for you or a permanent resident parent asking for you... I'm on that boat, my dad asked for me, but my brother will be a citizen about a year before my dad will.

as of right now, USCIS is working on I-130s filed by USC for their brothers or sisters from 2010. which means that you, if filed right now, will have a 2 year wait period before your I-130 is approved.

then what happens after your I-130 is approved, is that your case gets sent to the National Visa Center (NVC) from there you are placed in the F4 category. As of right now, the NVC is currently working on cases that were filed in 1996.

So you would have to wait until you priority date (the date that USCIS receives your I-130) to become current with the cases that the NVC is working on. the NVC is working about a week per month pace.

my mother filed an I-130 for me back in 2001 and i am under the 245i meaning that i will not have to leave the country, if and when, a visa becomes available for me.

the new "rule" may help you in terms of the amount of time you may have to spend out of the country when a visa becomes available to you.

i have an i-30 petition from my mom and i would have to leave the country to finish the process.luckily i qualify for the 245i. my wait time is 5-6 years but if my mom was an lpr i would have to wait 8-9 years . so she became a usc so i wouldn't have to wait as long. it also depends what country you are from i am from el salvador but mexicans and phillipine can wait almost up to two decades for lpr petitions.

also depends what age this person is because your not considered an immediate family member if your older then 21.

i was 17 at the time my mother filed my I-130 and although i am 29 now, i am still under the 245i because my I-130 was received before April 30, 2001.

April 30, 2001 being the cut off date for the 245i
