Hey guys,
my name is Tilla. I am new here, but I have a few questions that I really need help on. Do any of you know if an undocumented student can work if a company is willing to sponsor them? I got my bachelor's in engineering, and I talked to a company about a job. They think I am international, so I am scared to tell them of my situation. So, can anyone tell me how I should proceed? Please help me!!!

I'm in this situation too. I have heard rumors that you are disqualified from having an H1 visa due to you having been undocumented for a certain amount of time. BUT those are rumors.

i will be in this situation in a couple of years...
and i was really wondering about the whole sponsor thing... i guess that company can sponsor you if they show proof that the position has been vacant for more than a month (so citizens can apply before you i guess), then they can sponsor you...
My questions are I know this lady who does internships and hires people despite their status, she is with a church that builds houses and that sort of stuff... can she sponsor me? or how about some family that owns a business?

GrumpyDreamer is right about being disqualified for an H1 since technically, once you turned 18 and were accepted into college, you could have left the country and come back on an F1 or something. After staying in this country after 18, you are considered a legal adult and therefore, you made the choice to stay.

It's kind of a double edged sword with sponsorship for us. The thing is, there is no legal way (barring marriage) that we can adjust our status within the U.S. Even if we do get sponsored, we would have to leave the U.S --- but BAM - we have an auotmatic 10 year ban since we're out of status and so we're out of luck.

Anyway, I'm a junior myself that went through corporate recruiting and got an internship offer. I'm not rejecting it, though, since it's one of the best banks in the world. I can't work without an EAD and I know that even if I file for an EAD, I'll get rejected, so it's moot. All the major corporations do employment authorization checks anyway so they'll rescind automatically. But I rather pretend as if I have a future.

I don't know what to do. I want to talk to a lawyer about this, but the couple of times I did talk, they were very condescending and rude and did not give any hope at all. Plus, lawyers are so expensive!!! See, this is why Dream Act should pass. People who go to college to get a degree in professions where the US needs workers in but they cannot get employment, but they cannot get employment. Nurses, engineers, doctors, etc are direly needed in this country, but .....

I guess its just hard to take in the situation that we are in sometimes.

i know what you mean. i've been getting more depressed about my situation lately. i'm at a top ten college and all my friends are talking about corporate recruiting, grad school, and i have to sit there and lie about my plans as if i don't have any.

btw, i've talked to two great lawyers about my case recently. one is handling my situation pro-bono, the other i talked to had a 100 dollar consulting fee but literally had my case spelled out for me with all the possible options/outcomes (basically, i knew my stuff on immigration before and my status so i would know if he was bullshitting me).

i think any good lawyer is going to be expensive if you are looking for loopholes and what not. 10,000 dollars depending on how bad it is (and for us it's bad). if DREAM act passes, i'd hire a lawyer just to make sure i covered all bases in my application so I don't get rejected. I'm willing to get the money for it.

peija: sorry I overlooked you before, but there is one loophole that might be helpful to you. If you do have an employer that is willing to sponsor you and does not mind waiting, you can apply for an H1 visa, but you'd have to leave the US since you don't have the i245 protection. You'd get the automatic 10 year bar, of course, BUT your lawyer would have to file a waiver for you mentioning your extraordinary circumstance and thus allowing you to re-enter the U.S without any worries.

But:
1.) It's risky since once you leave the U.S, you are at the mercy of processing times and must have an understanding employer who'd be willing to hold out for you.
2.) No guarantee. It's best to have a degree on you since you'll be educated and thus, an asset to the economy. Doing this before obtaining bachelor's, master's, etc is ill advised.

You can't get sponsor by a company if you are undocumented. There is no way around it. Unless you are either the best in your field or a super athlete, and even then it's not easy.

If you are under 245i, then technically you can be sponsored. However, the odds are very slim, and even if you were to find a sponsor, the process is overly cumbersome.

I am currently in the same boat. I graduated from nursing school but can't take my Boards here in the us. I would have to take my boards in Mexico City which would mean i couldnt come back. I talked to a lawyer and they said their is a 10 year ban for being here illegaly and leaving. I would have to qualify for a waiver so that i could apply for an f1 visa, and nobody knows whether that would even be given. Anyways its a very complex situation. I talked to the lawyers in charge of this for the hospital in my town and they said they couldn't do anything to help me. What hurts me is that i am here, but they recommended not to leave because of the ten year ban. What i do know for sure is that the only way they can sponsor you is if you are not here in the us, which well sucks for all us. I don't know how much longer i can wait for reform. it so frustrating not be able to do what i worked so hard to do...............

that really helped out a lot, thank you lala.
i just didn't know the process at all....
im currently going to transfer to Washington State University, and i believe they are going to help me financially...(they have a really great program going on, to help people in our situation... unfortunately there is only around $300,000 or so...last year, i dont know the figure for this year, and there are 70 applicants)
getting sponsored would mean i would leave the country....so thats not a possibility....
