I've had a weird couple of days with uscis stuff and am wondering if anyone has had a similar situation:

I came to this country when I was 4 on a visa with my parents who came with work visas. They were doing this with the hope of working there way up to citezenship. They were waiting for years and then their work permits expired. I have lived the rest of my life having my own ssn and name but unable to get an id. I went to private school, college, and even got a job. My parents have excellent credit, good jobs, active in their communities, and none of us has ever been in any sort of legal trouble.

I applied for daca on my own in November with hopes of getting approved right away since a few of my cousins, who were in the same situation I was in, got approved weeks after doing their bios. After not hearing anything for a while, I started to get concerned (not to mention my rfe). Then about a week ago I got two letters in the mail from uscis addressed to my parents. I have not lived with either of my parents for years now and neither of them have lived at my address. Also, the name for my mom's letter was her maiden name that she has not had since 94. The letters contain bio appointments that are scheduled for next week.

My mom called the same lawyer that has been working with us since the 90s and she went to see her yesterday. The lawyer said that it appeared to be a final bio before they do interviews and take the citezenship test. She was not sure but is hoping to have an answer for them by next week. She also said that my case could be taking so long because uscis may be working my case as a citezenship case instead of EAD / daca case now. She also told my mom that it could just be that it is a 6 month wait daca, so not to assume anything too early on for my case.

Has anyone had a similar case and what were your results? Or does anyone have any advice? I'm baffled by what is going on and still have very little answers, but clearly there is something strange about what uscis is doing with my family and I.

Are your parents LPR's? Has someone else filed on your behalf such as a relative?

if your parents are not citizens how is it that the letters she got were for the citizenship test?

in order to file for citizenship, you have to be a PR first then after a certain number of yrs, you can apply for citizenship.

you can go online and type in the receipt number to see what petition USCIS is working on in regards to your mom.

also, USCIS doesnt hold up cases just because you file a new petition. you filed for DACA back in november, considering that there are still quite a few people from august and september that are barely getting approved now, your DACA application is still within the "waiting period".

Do your parent have a final order?
I'd be very weary because I've been through the same situation. I came on a visa, overstayed, got final order of deportation and we all received letters to go for an "interview." Spoke to a few lawyers who said it's clearly just a trap to have us deported. I could be wrong and your situation might be different from mine, but just please be careful. Good luck.

OP this all sounds so weird. I suggest you find out what this really is all about before your parents or yourself make any sudden moves. Good move to call the lawyer. Please keep us updated.

I would honestly call another lawyer. The lady does not sound competent based on what she told you.
