New York State Medicaid and DACA

I need to clarify this, a website called empirejustice.org is claiming DACA recipients are eligible for NYS Medicaid. Although there is NO source link to a .gov website that can verify the information. I am skeptical of the information and fear that when it comes time to apply for permanent residency I could be penalized for receiving Medicaid. I also found a statement on the Medicaid.gov website that says we are NOT eligible for medicaid. So my question to everyone in NY is, have they found any concrete evidence that we are eligible for state funded Medicaid? (im looking for a .gov website that can verify we are eligible)

Update: Also I've found 2 articles from NY times and CNN stating Obama Administration said DACA applicants do not qualify for Medicaid.

At the same time, in a letter to state health officials, the administration said that young immigrants granted a reprieve from deportation “shall not be eligible” for Medicaid or the Children’s Health Insurance Program. Administration officials said they viewed the immigration initiative and health coverage as separate matters.

The department determined that those with deferred status are not eligible for Medicaid or the Children's Health Insurance Program.


I would advise all to reconsider if they're thinking of applying, this could impact you down the road when you want to apply for permanent residency. Unless it is stated clearly that DACA applicants are elegible from a reliable government source, I would hold out.

from what i understand, Medicaid and/or Medicare are only for LPR and USCs. seeing how we dont have legal status (yet) i dont see how we, as DACA applicants, can receive state or federal benefits such as those.

Not true. In New York, anyone who is under 20 years are eligible for Medicaid. It does not required a legal status nor S.S.

I agree, that is true. But when it comes to DACA there is no hard evidence that we qualify.

That was my understanding, I was told states like NY offers medicaid to DACA regardless of what the federal law says, but cant find any proof of that

I have read it in several places that we are eligible for NYS Medicaid. Also, my lawyer confirmed it.

I haven't applied yet, but I'll talk to one of the healthplus reps for more info.

but what happens if later in the future you become a permanent resident will you any problems for using these benefits

Im sure lawyers and insurance companies will say "sure go right ahead, all u need is EAD and SS". What im looking for is concrete proof from a .gov website (e.g. USCIS, Medicaid, NYC.gov). From what i've read is that empirejustice.org is a law firm helping immigrants, but no where on the site do they give a source link that we are eligible. Just because they say so we must believe them?? Also what jesus is saying is a big concern, what happens when we apply for LPR and they check we've been receiving benefits without authorization.

By the way, I applied at the hospital in mid October, my accident and surgery was in the last two weeks of September. Medicaid letter stated that my coverage is effective as of September 1, 2012, which is great that it's retroactive, which means I can submit the insurance info to the bills I received so the doctors can get reimbursed.

I also contacted Fidelis while my application was pending and they wanted a letter from SSA stating that I applied for a number as well as the confirmation stamp that is on my biometrics letter stating that I have gotten fingerprinted.

Hospital was a lot easier. I would suggest making an appointment with them.
