Waiting 11 months for DACA.

Hi,

Hope someone here can give me reason to be more patient or advice on what I should do? USCIS received my DACA applications back on September 27, 2012 and to this day it's still on "Initial Review". I did my Bio-metric on October 19, 2012. I called USCIS once every month after it crossed the 6 month limit. I always got a robotic response from the call center who read out word-by-word what I can already see under Case Status section of the USCIS website. I gave up hope on my lawyer because he just keeps telling me to wait. I feel like he can do more if I pay him more, but not sure. I made 2 service requests so far. The first service request said "USCIS does not have a time limit for form I-821D" (although their website says it takes 6 months). The second service request replied back saying "Please allow 60 days for USCIS to process". Next month on Sept 27, 2013 will be 12 months for my case to be in "Initial Review".

I don't know what to do? Where to go? Who to seek help from? I have drafted a letter I wrote to my local senator because I found out about "Congressional Inquiry". I am planning to send it to him if I don't receive response from USCIS within their "60 day time frame" that they promised on my second service request.

I came to this country legally but my status expired, always paid taxes, finished HS and Bachelors in Engineering. I have no criminal conviction, not even a speeding ticket (parking violations only). I have never done anything wrong in my life and I qualify for everything USCIS asks for under DACA. I am completely lost. Has anyone been in this situation before? Do you know what I could do besides waiting? Thank you for your response in advance.

Some applicants have passed a year of wait time. You just have to wait and add a litte more patience to your daily routine. You are doing the right things in emailing and writting letters to uscis. The waiting game is like a daily torture but uscis likes playing that game, unfortunately.

take the next steps , try emailing the service center , next up the director , next up congressman

Do the congressman thing ASAP; try visiting their office to make things faster.

By the way, what's your age? Marital status? Children?

I called the congressman's office today and was transferred from one person to another. In the end couldn't get anyone to hear my problem. So I called USCIS again they gave me 2 email addresses to write to. I emailed them my problem. I think i'm going to try visiting the senators office next OR just mail them the letter. I'm waiting for 1 year to complete before i start knocking on political doors.

I'm going to turn 27 in November. Single. No children.

no need to wait on the 1 year seriously , its all a matter of how bad you want it , 1 day shy of my 9th month i e requested online , got a response several days later (wait some more) , 11 days later i emailed the center that had my application , policy is you should hear something within 21 days , the following week i got hit with an rfe!!! , meaning my application hadnt been looked at! , i was like you , oh well theyll eventually get to it , until someone pushed me to take action and i did!!! , this can happen to anyone waiting prior to their regular processing time

Try going to the congressman's (or woman's) office. Also, if you have USC friends in districts other than yours (assuming they know about your status), ask them if they can call their representative and ask in regards your status. I plan to do that if my representative doesn't help me much; I have two friends from other districts willing to help me right away, but I'm waiting for mine.

Also, do the e-request, since you've already been through six months, but in reality, YOUR wait was 90 days (same for many of us).

In another note...I'm gonna add your case to my theory about older/childless/not married people not getting approved.

Thanks for the support guys. They sent me an RFE finally after like a million follow ups. They received my RFE on Nov13 and said to wait 60 days. But looking at their track record I think i'm gonna have to stay underground for another eternity. Trying to stay positive!!
