Hey guys

I wanted to see if I could get some advice on a Deferred Action case I had open recently. I applied in Feb of this year and I received a request for more evidence in June. I sent in what I could and about 40 days later or so I received a notice that my cased had been denied because i didn't have enough evidence for 2007 and 2008.

My "lawyer" told me that I could re apply and pay the fees all over again but that without the evidence it would be a waste of time and money. So I kinda gave up hope after that. Everyone keeps telling me there has to be some way considering how long ive been here but I cant think of any way to make it happen.

Some background info -- i have been here since 1993 (4 yrs old) so I have a lot of evidence from when i was in school (ID's, certificates etc). But from Jun 2007 to Dec 2008 I was not going to school anymore and I was working at a business that my sister had at the time. I was paid cash so I don't have anything official from that time frame (Unfortunately I didn't think about doing my taxes those 2 years either). Beginning of 2009 I found a job somewhere else where i did start to get checks and i opened up a bank account so I have plenty of evidence from 2009-2012. It is just 2007 and 2008 where I really don't have a single thing to show besides a letter from my sister stating i was working at her business. Which is what I sent but apparently it was not enough.

Throughout the course of my case I would come on here a lot to see how it was going for other people. There was plenty of helpful things so I figured I would make an account and see what kind of help or suggestions I could get. Any ideas? Any and all help is appreciated.

Did you go to the doctor, dentist, anything? Was the letter done on a company letterhead or as an affidavit? On this site I found that people would get RFEs in 3-month increments, so for a few months that we didn't have anything, I sent affidavits for friends and neighbors. Also, were you on anyone's health insurance, car insurance, anything?

So my brother got an RFE for not having enough evidence for 2011, he wasn't working or going to school either, but he did volunteered at a local computer shop. We went and asked the owner to do some time sheets for my brother with his business name and his signature and contact information. He got approved because of that, we made sure he covered 2011... so since you were working for your sister, perhaps you can have her do the same thing, have her do some time sheets and sign them and put down her contact information and business name that she had, along with an affidavit stating that she did own the business and you did work there for the time being, also... affidavits from friends dude. THEY DO NOT HAVE TO BE NOTARIZED. pictures. did you go to Disneyland or somewhere memorable ? .... he he he he

Hi - Thanks for taking the time to read through all that!

I did go to the doctor in March of 2007 but they only care about Jun 2007 - Dec 2008. The letter was done as an affidavit. Once I was denied I looked around and it seems like they dont accept affidavits if its going to cover that much time. From what I read, a few months is ok but not for the 18 months I am missing. Do you think a company letterhead would work out a little better? I really wish they wouldve tried to call and investigate instead of just automatically denying the case.

No, i wasnt on anyones insurance. It almost seems impossible that I could go for 18 months without making a single trace but I really cant think of anything. A friend of mine suggested that I go and file my taxes for 2007 and 2008. Think that might work? It sounds like a good idea at first but then i think it might not be so good since it'd show i did them in 2013 and not in 2007-2008.

Haha, that is awesome! I think there must be some pictures. And alot of people have asked me the same question. But I dont see how you could prove what date they were taken on

That does sound like a really good idea though to make some time sheets. I shouldve probably looked around first before submitting the evidence i sent in. I was just anxious to get everything finished and didnt want to wait around. I figured they would look into it if they didnt like what i sent in but that wasnt the case

you know what, you can't prove that those pictures were taken during that time, but you're not going to write down "hey, so i think this picture was taken during this time" you're just going to label the picture with the information and you're done.. which is why i had affidavits to support those pictures also. When i submitted everything i just wanted to get approved right away, i know the feel bro, but.. before you do anything else, please please please triple check everything. Make a good TOC and don't highlight anything on originals. Also make sure your application is air tight man, just triple check everything.

Yea, I think that was the biggest mistake I made throughout the process. I shouldve looked into things and taken my time. The time stamps thing and the affidavits with pictures sounds promising though. I will try and put as much as i can together and give it another shot. Thank you for the help!

A company letterhead would definitely help make it official! When I was buying a house (and they're super strict on documents) my husband's job wrote a simple letter that said when he got hired and what he did. It had the company letterhead (super simple one), the address and contact info, signed by the HR lady. I put the addresses and contact info of everyone that I asked for an affidavit. You really need to get creative with your sister since that's really all you've got at this point!!

Did you make any purchases online or though phone order that were invoiced to you? In other words, do you have any invoices from that timeframe that are addressed and/or billed to you ?

Did you make any purchases for your sister's business where maybe you had sign somewhere? And maybe you could find records of that?
