Adjusting status after DACA

Hello everyone,

I am in the process of filling out paperwork to adjust status. My question is to those who have done so already, after receiving DACA. Did you file for a new EAD or not? I've read on different sites, that you cannot apply for another EAD until 120 days before it expires. So if you have adjusted recently, what did you do?

Your EAD will read C33 if you're DACA status, so you do have to file for a new EAD because you're going to adjust status which would be under a new category, for example C9.

I just applied for adjustment of status and my lawyer told me not to apply for another EAD Card with a green card you don't need an EAD card u usually get one until your green card is approved

What would happen if my case isn't approved before my current EAD expires?

You can apply for an EAD as a part of your Adjustment of Status application, if you do, on the I-765 you mark "Permission to accept employment", on question 11 mark yes and fill out the information about the DACA work permit, and on question 16 put down (c)(9)( ). Provide copy of approval notice for EAD, copy of approval notice for DACA, and copy front and back of the DACA EAD.

Alternatively, if you do not apply for EAD as a part of AoS and your DACA is close to expiration, you can still file for one under the AoS. You'll need to fill out I-765, same as above, "Permission to accept employment", question 11 yes, and fill out info about the DACA work permit, question 16 put down (c)(9)( ). Attach copy of the notice of the I-485, copy of previous work permit approval, copy of DACA approval, and copy of front and back of the DACA work permit.

If your AoS EAD will be close to expiration (which it shouldn't) you can file for renewal (mark "Renewal of my permission to accept employment), again file I-765, include copy of the approval for previous work permit, and copy of the I-485 notice of action, I am not sure if you're required to mail in the actual work permit or just copy front and back.

In either case, AoS work permit is free.

All of the above are free.

I applied for the EAD because my name has changed and in case I need to present it I want it to match with my social security card/DL which have my married name now, btw please let me know when you recieve the text/email that say that they have received your immigration package

Early this morning I received a text from USCIS around 12:30 am...kinda reminded me how happy I was when I received the same text for my DACA application
