Obama Will Halt Deportation And Grant Legal Status To Some Relatives Of Military Personnel

Federal immigration authorities will no longer deport non-criminal immigrant family members of former and active duty members of immigrants serving in the U.S. military, according to a new Department of Homeland Security memo released on Friday. Most notably, some undocumented family members of military personnel would also have a chance to adjust to permanent legal status.

The memo in part states that relatives without criminal records and who aren’t national security risks could apply for a “parole in place” status, thereby having their deportations suspended. The parole status is authorized in one-year increments and allows relatives who are legally here to adjust for permanent legal status. Others who can adjust their status include undocumented immediate relatives and employment-based immigrants who fell out of status for less than six months.

The "Parole in Place" policy for immediate relatives of military members is not new, I believe it has been around since 2010. I wonder what makes it different this time. Perhaps they're making the approval near-automatic for military relatives; in the past the relatives had to plead convincingly of their hardship, and approval was on case-by-case basis.

This is great news, but I am confused of how this came to be. I thought President does not have the power to fully legalize anyone... it's beyond his powers... and now.... he could?

USCIS, CBP, and ICE all have the power to parole in someone otherwise ineligible to come to US. This however doesn't fix any other inadmissibilities, like it doesn't clear previous illegal presence, or criminal bars, only thing it does is make the person considered to be paroled in (same as if a DACA holder were to re-enter using advance parole), therefore clearing the EWI and being able to adjust via marriage.

President could in fact issue an executive order pardoning all immigration violations. Which would open various sponsorship methods to people otherwise ineligible, however without parole or status those people would just start accruing illegal presence again and end up inadmissible the same day.

It could in fact be possible to pardon all immigration violations, and then have USCIS issue parole statuses to keep people from becoming inadmissible again, sort of keeping them in a legal bubble.

So the only way for me to take advantage of this, is to have my parents in deportation proceedings? Well that sucks.

If you're a military person then you can request parole in place for them, they do not have to be in deportation proceedings, just in case they are grant of parole in place terminates the removal as they are now legally in US.
