Hey guys not sure if this has been posted yet but it could potentially help some of the cases that are taking longer than "normal" processing times. Remember if anyone decides to do a FOIA to foia USCIS and ICE just in case.

FOIA Request Reveals DACA Checklist

Charles Kuck writes: "A client was waiting a long time for their DACA to be approved, so long in fact the it was even beyond the "normal" outrageous processing times. As most know, there is not much that can be done in such a case to "hurry up" the processing. We decided that we would do a Freedom of Information Act (FOIA) request for a copy of his file to determine what USCIS was doing with his case. Miraculously, we received the FOIA response back within 60 days. Also, miraculously, his DACA was approved shortly before we received the FOIA. So, why is this interesting? Because as part of the FOIA response, we received the USCIS checklist for DACA processing!"

Whoa. This is interesting. Definitely sheds light into the process and it does assert what I had thought. Any red flags that come up during the security checks can slow the process down by a lot; they have to go through the process of determining that the person with criminal record isn't you which can take weeks.

Interesting to see it but it doesn't reveal anything else besides what is originally requested.

It's kinda obvious that if the requirements asks for something and you do not provide it you'll get a RFE or NOID (Request for evidence or Notice of Intent to deny).


By the way? Does anyone know if there exists an internal checklist for form I-485?

The cost is minor, generally under 30 dollars. You're paying for photocopies + labor only.

if anyone actually took a look at that checklist, there is a checkmark on "Pending Name check"

i requested (by myself) my FOIA last year and i didnt get charge a penny. i guess if you reached over 250/500 (i forgot) pages then a surcharge will be billed. anything less is free at least in my case.

all i got from my FOIA packet is just a CD and all the information presented in PDF.

Yes I saw that. Probably one of the reasons this persons approval took so long.
