Need advice about abusive employer

Hey guys!

I have a friend who is working under the table at a restuarant, since she unfortunately doesn't qualify for DACA. The pay is a monthly pay (which is pretty bad in the first place). However, the scumbag owner has paid her about a 7-10 days AFTER 1 month of her start date, and post dated the check another week. Is there anything we could do to report this kind of abuse? She has quit after getting the post dated check and she's also worried that the check might bounce. Since it is an under the table position, I'm not sure what we can do.

Any advice??

I understand that it is under the table position, but your friend is still entitled to be paid for her work. If the check bounces, and her old boss is unwilling to cooperate, I would recommend your friend to seek out to non-profit organizations whether it is immigration or labor.

Steps she can take:

1) If check bounce then ask her boss repay with bank charges.
2) If boss is not cooprative then seek immigration lawyer to see you may be eligible to proceed with U-Visa if case is filed against her boss. I would gather all evidences that she worked there while she wait to clear her check.

I would threaten the boss of DOL action and demand my paycheck. And try to look for another job as soon as possible!!

Edit: Just saw that she quit. That's good. Now she should go straight up and demand her money or else contact DOL. DOL could shut his business down for first of all hiring undocumented individual and on top of that ABUSING that individual. DOL protects EMPLOYEES, WORKERS, people who provide LABOR. Tell your friend not to be afraid at all and go demand her money.
