Responding to my RFE

Hi everyone,

I received this RFE letter today

I answered no to being arrested and charged because I was never charged, I was only in the car with someone who ended up being charged. The only reason I was taken into custody was because I was with the person. When they released me, I got a copy of a notice from the police dept signed by the releasing officer that I was released without charge. I was going to send them a copy of that along with this letter.

Do you guys think that's what I should do? Any advice would be helpful (I'm trying to avoid spending hundreds on a lawyer but will if it's more beneficial)

I also read that if you have ever been arrested, you should obtain a copy of your criminal history to send in as well. However, since I wasn't charged, do I even have a criminal history?

Cover all your bases and send it. Even if you were not charge you were taken into custody aka ARRESTED even if you were released afterwards you were in fact arrested.

So should I call the county clerk and get my arrest record? Do you think I've covered all of my bases by sending in these 3 documents? I"m not sure what else I could provide them since the invoice from the PD is the only thing I've got.

That letter you wrote is fine. You're explaining the reasoning as to why you said you had never been arrested.

I actually went through this when I applied for DACA. I was arrested and charged, but charges were dropped. I had just sent my application about a few weeks before the arrest. I then received a RFE notice, because I guess when they started processing my application they saw the arrest. But at the time of my submission I had not been arrested. Therefore that was the reason why I answered "no" to ever being arrested. I explained why I said "no", and sent in only the requested documents. I was approved.

They see your arrest because now your fingerprints are in the arrest database. Just make sure to send in an official court disposition (it will have a stamp/seal) and whatever other documents they are requesting.

Thank you so much for the help! I went to the court office today and got the document I needed, I will be sending it out tomorrow. Do you remember approximately how long it took for you to get accepted after you sent back the RFE info?
