So I've been researching and I cant find anything. I am from new Mexico where our gun laws aren't to strict but I was wondering if anyone had an answer or if they bought a gun from this state and would like to share. I went down to walmart to buy a shotgun but the machine was asking me for an alien number I think it was because I put I wasn't born in this country. Do we daca students have an alien number? Any help would be appreciated. Thanks.

Bro, why do you need a gun? Isn't it safe at your area?

US v. Huitron-Guizar by the 10th District Appeals Court found that illegal aliens, and other irregular aliens, are not able to own or possess firearms at the federal level. The 2nd ammendment explicitly does not apply to us. Which begs the question of which parts of the Bill of Rights do apply to us...

So no.

Basically the people was meant for citizens of a country.

So us the illegal people are not citizens so really any part of the constitution that gives rights to the people does not apply for us.

And that was taken to the supreme court wasn't it ?

Be interesting if right wing siders decide to use that case against us

Basically yes.

The full text can be found here for those interested in the full legal treatment.

Quote:
...

The alien, to whom the United States has been traditionally hospitable, has been accorded a generous and ascending scale of rights as he increases his identity with our society. Mere lawful presence in the country creates an implied assurance of safe conduct and gives him certain rights; they become more extensive and secure when he makes preliminary declaration of intention to become a citizen, and they expand to those of full citizenship upon naturalization.

This ascending scale of constitutional rights is elaborate. An alien outside the country has fewer rights than one within, e.g., an alien held at the border has no right to a deportation hearing...
I like to summarize it as:

Full citizens have the most rights.
Followed by legal migrants inside the US.
Followed by illegal migrants inside the US/legal migrants outside the US.
And non-citizens have no right. Because fuck you, USA! USA! USA!.
