Valid I-94 For Driver's License

Ok, i was very bored looking at some cars, E-window shopping if you will, and on one of the websites i came across the link to the California DMV. So i browsed around and found a link to what requirements are needed to get a driver's license. The link is http://www.dmv.ca.gov/dl/dl_info.htm#BDLP

It says under the "Birth Date verification and legal presence requirements" that for me to get a License is to show my "Valid foreign passport with a valid Record of Arrival/Departure (form I-94)" Which i do, my Passport AND Visa is good untill 2010, so if thats true and this information is on the California DMV Website so i'm sure it's legit, I wanted to ask you guys if it is legit.

I came to this country on a Tourist Visa with my parents and over stayed but it's still good though untill 2010 like i said, so what you guys think??

No. It would still be a problem. You are only authorized to stay in the U.S. for the period indicated on your I-94. Remember, a tourist visa is a non-immigrant visa meaning it is only temporary and not a permanent visa, unlike an employment or family visa.

You are legally authorized to stay for the period indicated on your I-94. Any stay beyond that period is unlawful. Your visa isn't the I-94 document. The I-94 is a document issued by an immigration officer at the point of entry. Your visa is issued from the U.S. consulate/embassy of your home country.

This is why DMVs ask for a valid I-94 and not a valid visa. A visa is COMPLETELY DIFFERENT from the I-94 document.

A tourist visa is valid for 10 years. Your visa is now void because you have overstayed your period that you were admitted for, which as a tourist is usually for 6 months and sometimes in rare cases 3 months if the immigration officer suspects you coming here for more then just "tourist purposes"

If your I-94 expired dont even bother to try. You can't do it with the passport or visa by itself. I had a CA Drivers license when I had my valid I-94, but the drivers license expired as soon as the I-94 expired.

In Florida, you can get a Drivers license even though the i-94 is expired (must have an i-94 though) The catch is you must have a Family petition pending. Not necessarily a petition from a citizen, could be a LPR. any type of petition will do (as far as i know)

I've heard of some getting labor certifications, getting a rejection letter from USCIS, going to the DMV with letter and getting the drivers' license. risky loophole. dont try it at home kids.
