I recently got married and my husband is a US citizen. I entered the US with a visitors visa as a child and overstayed. I'm planning on doing all the necessary paperwork myself and currently gathering all the forms needed. I currently have work authorization through DACA so I was wondering if I should still fill out Form I765. Thoughts anyone?

Also, I welcome anyone who's been through the process or going through the process to share their story or advice.

Most people say to get the EAD because you're basically paying for it in the fees. What I think is that you should consider the expiration of your current EAD. If there's more than 1 year then applying for a new one would be kinda silly since the new EAD would be valid for a year. If it's less, then go ahead and get a new one.

Thank you for your response. My ead just got renewed a couple days ago which means I'm good for 2 years. I see it wouldn't make sense to file another I-765 in my case.

I would highly recommend you to reapply for I-765 threw the green card process. The EAD would be in a different category (marriage category) and you could have a combo card with advance parole and work authorization (thats if you concurrently file I- 765 and I-131) so you can leave the US and re-enter while your waiting for your green card to finish processing and you can go apply for a normal SSN# without limitations on your SSN and you can apply for financial aid for college and also get a normal state ID or driver license without it expiring the day your work permit expires and many other things you can do with the new EAD card threw the marriage green card process.

Thank you for your advice Ric2014. You raised some very good point. It does make sense to reapply for work authorization through the green card process.

Congratulations! I will keep you guys posted. I'm not applying just yet because my husband and I aren't living together due to a couple curve balls mainly financial reasons. I'll wait until I move in with him and we get my name on the lease as well, hopefully early next year. We got married at the courthouse but I'm having a religious ceremony next summer. I figured I should start researching and getting my applications together. It's a process but at least I've started. We also got joint bank accounts a few weeks ago so little by little we're building our life together.
