Need AP to Visit my sick mom in Brazil but I am Afraid

My mom used to live here in US, she went to Brazil to treat her disease. She can't come back to US. My brother just notified me that she is doing very bad. I want to try to apply for the AP, however I'm afraid that even if I get approved for the AP, they wouldn't allow me to reentry US ground.

Anyone know of a case where someone was denied reentry US with a AP?

Joao, There hasn't been a case of denied entry here on DAP. You can read the threads on AP and read about the experiences going through customs. I think there are two Brazilians here whom came back recently with AP (carnivore and another one), you can search "Brazil" and find them.

You have a strong case for AP, I think you'll be easily approved. As for coming back into the U.S., you have to realize that advance parole is "permission from the government" to be paroled into the U.S.. You'll be an applicant for entry and if customs find any inadmissibility (drug use, criminal, or health bans) then you will be barred from entering. If your only inadmissibility is being in the US illegally, you won't be denied entry because of that.

Malignon, thank you very much for the response. I am really concern about not being able to reentry US. Both me and my wife are in college now, and I am responsible for all the bills. We could not afford me not being able to come back to US.

If you can prove a humanitarian need for the AP then you will have no problem in getting it. As well as you don't commit any crime in Brazil or bring back any crazy health issue then you should be granted re-entry. Good luck and I hope your mom gets well soon.

What I would do is get the proof that your mother is Ill and sick, package should be AP application, letter explaining why you need to go , doctors note, pictures, and money order, copy of your ID and approval notice I think. Mail it to them then, once you get your receipt , go to your local uscis office and ask for an emergency advance parole. They will say they dont process then there, tell them you read in their site that on extreme emergencies they do. They will sent to the lounge were someone will call you, there with the receipt which is there to prove your made the payment, they will approve your AP. This will take around 1 week.

Don't be afraid because you' have a genuine reason! Get the proof from there and apply! People are getting AP to visit grandparents. We're talking about your mother here! Good luck and hope she gets well soon.

Make sure any documents or notes from Brazil are translated (by a certified translator) before sending it in, to prevent any delays on your process.

I recently sent my application for AP as well, good luck!
