Renewal timeline question

My EAD expires on 2/1/2015. I MAILED my application to the Phoenix Lockbox location on 10/2/2014 (which is 120 days from 2/1/2015 ) and it ARRIVED in Phoenix on Saturday 10/4/2014. I got the email that USCIS got my packet on 10/9/2014. IF they take MORE than the 120 days (which I could literally bet my life that they will) will I be able to get an interim EAD while they still work on my case?

I had monetary problems and could not send it any earlier than I wanted.

My case is very simple with no criminal record and all the same data as before.

No, USCIS page says if it takes longer, the will give out extensions, but it has been confirmed via people calling and asking them directly that they are no longer doing that.

I just got the letter from USCIS and it says: Received Date 10/6/2014 and: Notice Date: 10/2014. So by which date do they go by? If it is by the 10/6/14 then it is FOUR days OVER the 120 days mark! I am just having nightmares about having to leave my job because they will not approve my application on time.

BUT USCIS also says that as long as we send our packer ABOUT 120 days before the EAD expires THEN they will give you an interim EAD while they still process your aplicatoin.

I do not know how lenient they are being.
Can anyone corroborate what I am saying?

Haven't heard of anyone getting an interim EAD so I don't really know if they are.

You couldve sent it 150 days prior to expiration btw. They will count the day they received your application so the 10/6 date

OK OK! So USCIS is not giving interim EAD's? For what I read on thier website they can give you and interim EAD as long as you sent (or get, but I am not sure which one it is ) your packet ABOUT 120 days prior to your current EAD expiration date. Here is the language from the USCIS site:

"You should submit your renewal request about 120 days (4 months) before your current period of deferred action will expire. If you submit your request more than 150 days (5 months) before your current period expires, USCIS may reject it and return it to you with instructions to resubmit it closer to the expiration date.
"

Notice the about language and it also says this:

"Note: If USCIS is unexpectedly delayed in processing your renewal request, we may provide deferred action and employment authorization for a short period of time until we finish processing your request. We may do this if you filed your request at least 120 days before your current period of deferred action and employment authorization expire.
"

I suggest you call USCIS and ask yourself, as I said, many users here have confirmed with USCIS themselves that they are NO longer doing that. Why the website hasn't updated its anyones guess. But please do call and verify with them
