My dad just passed away about an hour ago...all I have is my work permit thanks to DACA
I NEED to go to Mexico and be with my mom, I already booked a flight for first thing tomorrow morning.....how can I come back??????

Well first of all I offer you my deepest condolences. I can't even imagine how are you feeling and I hope the best for you and your mom. I really don't know much about the issue but I'm guessing you won't be able to legally return to the States if you leave tomorrow. Once again my knowledge on this issue is very limited so I hope somebody else is able to guide you.

I am very sorry for your loss. However, It is very likely you will trip the 10 year ban if your leave tomorrow.

You could apply for Advance Parole for humanitarian reasons and get it expedited, however this will take at least 2 weeks possibly more. Maybe seek out the help of your local congressman.

It would normally take two weeks but what you can do to make it even faster is this.

1) Make an application for AP, pay the fee and whatnot, gather your evidence and send the package on express mail
2) Make a second application as above but without the money order again.
2) You will then get a receipt number - this is important!
3) Take this receipt number and second AP package to your nearest USCIS center and tell them you need to apply for EMERGENCY advance parole -

A completed and signed Form I-131, Application for Travel Document

Two passport-style photos.

The USCIS office wont be able to do anything unless you come in with a receipt number.

If you do this right, it should take less than a week.


If you leave right now, adios DACA, adios everything you have worked for.

I repeat YOU WON'T BE ABLE TO COME BACK!!

You need to apply as soon as possible for Advance Parolee with the help of your Congressman or U.S Senator! Probably it could take 1-2 weeks for it to get it done.

I'm sorry to hear about your lost but if you leave tmrw you would probably regret it for the rest of your life. It's a hard decision.

So sorry for your loss. I can't even imagine being in such a tough position like this.

Honestly though, you should stay and wait it out. You won't be able to come back and there goes everything you've worked for. Sadly, your father is gone and you going tomorrow will not bring him back. I really hope this turns out well for you.

Really sorry for your loss, but as hard as it is, you need to gather your thoughts and think about what you're about to do. I don't think your dad would want you to throw away your life just to be near his earthly body. I don't think your mom would want you to throw everything away either. Mourning is something that can be done from a distance and with technology now, it really can help to be closer to loved ones. Get your AP first before you leave the country.
