NJ joins lawsuit against DAPA/DACA

Gov. Chris Christie is supporting Texas and other states suing the federal government over President Obama's amnesty program for unauthorized immigrants.

Christie this week joined governors in three states — Texas, Louisiana, and South Dakota — in a court brief opposing the federal government's request to implement executive orders, according to court documents. The lawsuit stems from court proceedings initiated by 26 states after Obama announced wide-reaching executive actions on immigration in November.

New Jersey and the governor did not join the lawsuit. Rather, the governor opted to weigh in with the court arguing Obama's policies should not take effect.

Christie has been critical of Obama's immigration policies, but had yet to publicly take a position on the lawsuit that Texas officials are spearheading.

The news of Christie joining the lawsuit took some within New Jersey good-government groups by surprise, including Ari Rosmarin, public policy director for the American Civil Liberties Union of New Jersey.

"When the lawsuit was first filed the state took no action," Rosmarin said.

"Now, to see Christie enter himself as governor on to this brief with the likes of governors of Texas, Louisiana and North Dakota is really shocking and shameful," he said. "These are not New Jersey values."

Texas Gov. Greg Abbott's administration filed an amici curiae brief, or a friend of the court brief, earlier this week with the U.S. Court of Appeals. The filing -- which Christie and the governors of Louisiana and South Dakota also signed onto -- opposes the U.S. Department of Justice's request to implement programs that would give some unauthorized immigrants the ability to work and obtain a driver's license.

A Christie spokesman confirmed the governor signed on, but declined to provide comment.

The filing argues the governors' states would be victim to "irreparable injuries" if the federal governments motion to implement the programs — Deferred Action for Childhood Arrival and Deferred Action for Parents of Americans and Lawful Permanent Residents — is approved.

"The question presented is whether the president can unilaterally legalize the presence of millions of people and unilaterally give them myriad legal benefits, including work permits, Medicare, Social Security and tax credits," the filing reads.


Nearly all of the states suing the government over Obama's executive orders are led by Republican Governors.

Unauthorized immigrants made up more than 8 percent of New Jersey's workforce in 2012, the fourth-highest such percentage in the country, according to a report released in November by the Pew Research Hispanic Trends Project, which found the state saw the largest recent increase in the size of its unauthorized immigrant population of any state in the country.

"I don't think New Jersey is aligned with Louisiana, Texas and North Dakota," Rosmarin said, implying Christie has presidential politics on his mind.

"Obviously everybody has his understanding of why he's doing this," he said. "But I don't think he's going to find a lot of support in New Jersey."

In November, Christie and other Republicans were ready and willing to criticize Obama ahead of his planned announcement then declaring the use of executive order to spare nearly 5 million unauthorized residents from deportation.

While declaring Obama dropped the ball on immigration reform, Christie, a likely 2016 presidential contender, refused to articulate his position on the issue unless he runs for the White House.

The New Jersey Alliance for Immigrant Justice also slammed Christie's decision to submit the friend of the court brief.

"Governor Christie's support of this misguided lawsuit is further proof his political aspirations trump the needs and will of the people of New Jersey," the group said in a statement. "This is a betrayal of our families, our communities, and of all New Jerseyans."

I don't think he means it like that, I think he meant by doing an expansion of DACA and DAPA, he has made OUR DACA (2012) more known to those who otherwise wouldn't really care. Even when 2012 DACA was getting heat, the worse was from Arizona who refused to grant licensees and all, some suits here and there but nothing major. Now that more people are taking a stance agaisnt DACA, those who are agaisnt it are more organized that those who are with it. It was with Arizona, now more and more states joining one way or another.

DACA is better than nothing but nothing is not better than well nothing, DACA isnt secured, and the next president can just get rid of it as easily as USCIS made the memo, the GOP are idiots are for attacking it to be honest but sadly, people who take action are with them.





In Oregon, one of the supposedly immigration friendly states was granting licenses back, granted they were mark but beggars cant be choosers, well a group organized founded by some guy from a different state, and they managed to put that already signed bill that would have taken effect in 2014, into the 2015 voting, well, now with more Oregonians becoming aware, they voted NO to pass the bill that would grand us licenses

ok, I agree that this does put the original DACA back in the spotlight, but it also had a lawsuit too that was eventually thrown out, it never pause the program so most people were not following it too much or were negatively affected. I don't think the republicans will try to touch original daca at this point since so many already signed up, worse case we lose extended DACA and DAPA.

I dont think think will lose them but I feel more and more people will become aware of it and if they do, they might actually start taking personal action towards it
