My mom is currently a PR and from the visa bulletin, it looks like I might have to wait a bit less to get my pr than if I was to do it while she is a citizen. Strange.

Do you guys think it's a good option I do this while I live with DACA til the priority date arrives 7 years later? Or should I wait for some sort of immigration reform?

My other question is that if I do file for AOS through my mother and some sort of immigration reform does pass, would I be able to apply through that and just cancel out my application through my mom?

Thanks for any input.

Are you covered under 245(i)? If so then by all means, go ahead. Otherwise, you can, but said petition will likely never result in a green card.

Have a pending petition gives you nothing. No protection from deportation, no right to work in US, etc. If some sort of reform passed you will be able to benefit under it.

I entered the country legally with an I-94.

Can I benefit from a reform while I have a pending gc petition?

It can't hurt. If reform does pass or if you marry a US Citizen before priority date comes up then worst case you lose the money spent on filing the application.

well actually Im in the same boat as you and I saw an attorney and he said we can apply for Advance parole and when we travel and come back to the US, we will be erased from past illegal presence so no 10 year bar considering you have not committed any crime and then remain on DACA or even apply for a student visa while you're aboard if you would like but he said he believes DACA won't be terminated, so I have about 6 years too with my PR mom. Careful with information you get online from other people who don't know much.

I never hurts doing it. I've been approved since 2005 through my mom, a PR now citizen, just waiting for my priority date, which would still take some 15 years because there's a huge backlog for mexicans, that is Mexico doesn't get a big visa allocation.
