Hi all,

I have seen quite a number of thread about getting an adjustment of status with an advance parole.

However, I've been researching some options for my boyfriend - he entered at 2 years old with his mother with a visa/passport (with inspection) that expired in 2000 - i.e. he overstayed and lost legal status.

I've found a number of people claiming on immigration law forums that because they entered with inspection, they can qualify for an adjustment of status without having to leave the country (if they are a DACA beneficiary). This can supposedly be done through petition from a immediate relative who is a citizen or resident (mother, father, bother, or sister) or through marriage to a citizen or resident.

Does anyone know if this holds true? Has anyone heard of this working as a means of obtaining a green card?

Help!!

Since he entered with inspection he does not need AP. AP is used to clear EWI. Your boyfriend is not EWI.

He can adjust his status through marriage to a USC or through a relative (I belive it is only mom and dad that count) if they are a US citizen.

Daca is irrelevant in his case. He can adjust with daca active, or he can adjust without daca.

Thanks, I haven't had anyone confirm this for me yet - now I know more

Appreciate it
