Parent is citizen, I am a DACA recipient

So I've been searching the web and I cannot find a definitive answer to this question: If my dad is now a US citizen and I am currently a DACA recipient. What avenues can I use for legalization?


The only path I see from:

https://www.uscis.gov/family/family-...nent-residents

Is going back home and applying for a petition that hopefully keeps me from a 10 year ban. Then regular I-130 form. But that entails me to go back home... and that doesn't guarantee that I get approved for the 10 year ban waiver and petition. (although it's at least something).

Anyone know a little more about this?

Hey man, same problem here. I've contacted one of the better immigration lawyers in my city and she's gone over my case and has basically told me that there's nothing I can do.

AFAIK - having DACA status doesn't help you at all with any sort of avenue regarding legalization because DACA does not grant you legal presence. We are technically "lawfully, but not legally present" in the eyes of the law.

Edit: Are you under 21? If you are, you can adjust status normally.... and shouldn't even bother with DACA.

I'm in a similar boat as you, my father is now a US citizen. There's also the option of doing a 245i adjustment of status while you remain here in the US if you had some immigration petition done on your behalf between 1998 and 2001. That's what I'm currently in the process of and having my fingers crossed that everything goes well!
