Hi everyone,

I had interned at Intel last year and I got an offer to work there full time, but they now rescinded the offer since I don't have a green card or a visa that allows me to be sponsored; I emailed the HR person that I do not need sponsorship to work.

I remember that someone here got a job in Intel. Did any of you have a similar experience and do you any advice?

Thanks

This happened to me as well but with another Fortune 500 company. I was offered an internship and then it was rescind because they thought I would need sponsorship with DACA. I had to send in a letter explaining what DACA is and a couple of people internally helped me to get a full. Time job there after I graduated.

It does happen and it has happened to other people. Usually happens in bigger companies.

Its common, honestly now I don't think its a bad time to write in bold in your resume that you do NOT need sponsorship

You should also keep in mind that Intel just had a huge layoff. Could also be part of the problem

An update in case anyone was actually curious. This is the reply I received from them even after I clarified that I don't need sponsorship:

Quote:
I have received clarification of your case from our law firm and this is the information :

Intel's policy is to hire only foreign nationals that it can successfully immigrate and get permanent right to work in the U.S. While you have a temporary work authorization through your DACA EAD, current immigration law does not allow you to become a green card holder. Hence, we have to deny the process.

While DACA beneficiaries are eligible for temporary work authorization, deferred action does not provide lawful status. Since DACA does not confer lawful status, the DACA beneficiaries are not eligible to be sponsored for a green card.
I need to find another job I suppose, but I am not sure if almost all companies will do this at this point.

On to the next! If you're good enough to get hired by Intel for the internship in the first place, you'll have no problem finding a better job!

Good luck!

Problem is that any company with the reputation will have a similar policy. Now this is something we forsaw years ago. I can't find the thread but basically we people who have DACA can legally be discriminated on when it comes to being hired. Why?

We don't have legal status we have a lawful presence status. All work anti discrimination hiring policies only protects legal workers NOT lawful.

A company cannot deny you work base on your reoifon but it can base on your status. All they have to say is you were not hired because your status isnt legal. And they would be right.

Anyway don't let this get you down and start searching. Now about your resume. I don't know if I would put down that intership with Intel because Intel is pretty big. Whoever reads it will ask why weren't you hired there. You will have to make up some story about it.

Intel's law firm messed up big time. We have lawful status we dont have legal status. Those idiots don't seem to understand DACA at all. You cannot have an EAD with out being here lawfully.

Why wouldn't he leave the internship experience on there? He can very well say he wanted to go another direction and leave the reputable credentials on the resume.

As posted in another thread, there's Dreamers that work for Intel or other large organizations full time, so it comes down to the HR rep not the company size as a whole.

Why would you intern at Intel if not for the opportunity to work there? I worked at Intel years ago and I never met anyone who got an internship and decided to go a different direction.

Now Intel's HR policy is very complicated because if they are not hiring USC they are hiring Indians and other foreign workers with a work visa who can be sponsored.

Deferred action isnt new but at a massive scale as DACA many companies are perplexed at understanding its nature. Part of the recent supreme court hearing was what lawful actually meant. If the supreme court is wondering what lawfully actually means chances are companies and their law firms dont know squat. How can we do anything about this when top law firms and our supreme court dont even know what lawfully entifles us with ?
