I know people who entered the country illegally have to go back to their native countries in order to get married. But what about those who got here when they were under age? would we still have to go back and get married there?

It depends if you came here on a visa or not.

If you came here on a visa, you don't have to go back.

If you came here with out inspection (no visa) AND fall under 245i you don't have to go back,

If you came here without inspection (no visa) and do not fall under 245i, you have to go back.

It doesn't matter if you were 1 month old or 30 years old, even if you were only a baby.

About what? You can get married here. Go to the courthouse, get a license, go in front of the judge or to a church, and get hitched. I think somewhere in Virginia recently passed a law making it to where undocumented immigrants couldn't get married, but that's isolated.

Youguysareawesome said it right. It doesn't matter how old were you at the time you arrived. So basically age isn't a factor here. If you came here illegally without a visa and you don't fall under the 245i you can still get married, but you CAN'T get a greencard.

You can still get a green card, you just have to leave the country and file for an I-601 wavier. If this is the case. Check out www.immigrate2us.net
Certain countries such as Mexico have decent approval rates for the wavier. It's much riskier than adjusting in country but at least it's an option.

the I-601 has a huge fatality rate. It's not even worth mentioning, and the spouse usually gets approved on special circumstances.

Depends on the location. It's something like 80% approval in Mexico and pretty close to that in the UK.

so if you came here legally (w/visa).. and get married to a USC, you dont have to go back to fix right? .. where as someone who came here illegally has to go back regardless if they married a USC.. am i right?
