Unlawful Presence Waiver

Hi,

Thinking about getting married to my USC boyfriend and applying for a green card. I have a EWI, and know that I will have to leave the US for a consular interview. We are researching the unlawful presence waiver, has anyone applied for it? Is it hard to get it approved?

We are also looking for an attorney to help us with the process. I had a friend who filed everything on her own and was successful. Her husband had a green card in about a year and only spent 3 days out of the country. But I don't want to risk it.

Were you petitioned for papers by anyone who was a US citizen or green card before 2001? I've heard that if you have a lawyer the process is a little faster.

No, we are planning in getting married next month and then start the process.

Thanks for sharing the story about your friend getting through with their green card via provisional waiver. That will be my last resort if I do not get approved with advance parole because I'm already married to a usc. Best of luck to you too in attaining your green card.

If you're EWI with NO REMOVAL ORDER then AP via DACA to clear your EWI is your best bet. At least that was the best route up until Trump won, we don't know what will happen with him.

I'm in a worse situation as I do have a removal order so AP is basically out the question for me right now.

What was your friend's case for extreme hardship? The success of the unlawful presence waiver (I-601) depends on your case of "extreme" hardship to your USC spouse. Common results of the bar, such as separation, financial difficulties, etc., in themselves are insufficient to warrant approval of an application

Please somebody help!?
I recently got approved for advance parole. I have daca and i already have my plane tickets for january 3 to january 9 2017.

My question is am i gonna have any trouble at the port of entrance coming back in the U.S.?

I dont have any criminal history or deportation orders.
Only thing im scared of is that i came here undocumented the first time when i was 6months old but then left to mexico like around the year 2000 (9years old) then came back mid 2004. I entered at the port of entrance behind an suv truck (but never got cought by immigration). When i filed for daca i listed that i came back the second time because when i was in mexico i applied for a visa but was denied.

So my question is are they gonna make it a big deal for my second entrance. Somebody please answer me?. By the way i never been caught by immigration.

I know there's not a lot of information on here about unlawful presence waiver success stories. So I'm recommending this site " Immigrate2us.net" there are a lot of people on that forum with experience with 601a provisional waiver and other immigration issues beside Daca.
