Talk to lawyer for DACA to AOS

And she said that there's a chance I can get my green card denied there and I would have To go to ciudad Juárez to get my green card approve even if I use AP to clear my ewi. And wants to charge me 4000 dollars plus fees. Been married for 9 years and have 3 girls with my wife. So now I'm left with the feeling that if I apply it would be a waste of money since more Lilly's I would get denied a green card. Oh yea and I have a super clean record with the law

Lol. Well my question was is have any daca to AOS have got denied for the reason we have daca and use AP? And should I believe the lawyer that most likely I would get denied

Did you use advance parole already or your planing on doing it ?

Your case is pretty clear cut I wouldn't see any problems advance parole clears EWI. One of the requirements for adjustments of status is for the person to have been admitted legally or otherwise paroled into the United States .

The fact your lawyer wants to charge. $4,000 for an adjustment of status via marriage is a serious red flag . The typical cost is around $2500 plus fees.

Some lawyers like to fear monger especially if they are not good lawyers . This is prevalent in the Hispanic community .

I would get second opinion I will be meeting with my lawyer this Thursday and will post an update .

Also make sure you are actually meeting with a real lawyer and not an immigration consultant because if things go south your on your own .

Thanks for the info, I'm gonna make another appointment with another laywer to get another option. Yea that's I was thinking that it's too much money

So far i talked to 2 attorneys and they both agreed that AP clears my EWI and that I can adjust my status without leaving the country. However, one attorney advised me to wait 60 days before submitting I-130 because they might deny it for the reason that I took AP to clear my EWI and not for humanitarian cause. They also mentioned that depending on the adjudicator, they might ask for a waiver for the time I accrued unlawful status before they granted me DACA and traveled with AP. In this case, I can appeal the case to Administrative Appeals Office and, if everything goes as the attorney said, they can hold the the matter of Arrabally and Yerrabelly in my favor. I ll probably see one o two more lawyers before I make my mind how I want to proceed and if I need a lawyer. I just don't want a pay too much because I feel my case is not that complicated but I'll let you know guys how it goes.

This is probably why your lawyer said you can get denied even with Advance parole .

AP clears EWI. You can file for AOS immediately, I filed our paperwork a week after arriving. If you have a clean record, I suggest looking into self-filing, some of us have done it without any hiccups. My green card was in hand four months after filing.

Any immigration petitions, like DACA, are on a case by case basis. So someone getting denied AOS may be very specific to their case or history to draw any conclusions. Having said that, your case does seem clear cut if you still have DACA and no criminal or deportation history. And considering you're married for 9 years and have 3 children from it, seems like a strong case. You'd get an unrestricted green card (not conditional). i agree with post before

Have you look into I601A waiver? That's another option for people with EWI.
