i will type korean,

Hey man, as Dogshekki nim said, go to the nearest consular office and postpone your service. You need to do this before the age of 25; otherwise, you will obtain criminal offense. You CAN POSTPONE YOUR SERVICE.

Well, I don't usually post anything here, but since this is exactly my boyfriend's case I figured I should share. If you're a Korean male, you can actually postpone your military duty regardless of your illegal(or DACA) status. You just have to visit the nearest Korean Consulate and prove that you have lived with your parents in U.S more than 5 years. But you MUST, MUST do it before you turn 26 years old. After that, basically you're accused for evading the country's mandatory military service, and the Consulate won't issue or renew your passport until you fulfill your duty. Unfortunately my boyfriend hadn't done so, and he's EWI with no passport. So, he won't be able to adjust his status thru AP even if we get married(I'm USC)

I'm curious now, how does he even adjust status? Can't get a Korean passport until he fulfills military duty, but can't fly to Korea unless he has a passport. How does the Korean consulate expect him to even travel then?

I have a similar predicament for my home country (not Korea) that has national service for their male citizens. I have to read up on the rules soon but I'm waiting for AOS (expired visa and married to a USC) here first before attempting to even renew my passport at the consulate.

Going out of country to your native country, you don't need a passport.

The consulate issues a temporary passport which is only valid for going back to Korea. But unless he serves military, he won't be able to come back. Oh well, at least he has DACA I'm keeping my fingers crossed for RACA to pass
