Sen. Susan Collins (R-Maine) says the deportation of a man protected by an Obama-era immigration program breaks with President Trump's pledge to find a deal on "Dreamers."

"I'm troubled by it. It seems to me if a child is brought here by his parents, that that child didn't really have any say in that decision to come here," Collins told Maine radio station WVOM on Wednesday.

She added that the action did not align with Trump's pledge to find a deal on the Deferred Action for Childhood Arrivals (DACA) program.

"It does seem to contradict the president's own policy, because he too has expressed sympathy for children who were brought here and have grown up here and in some cases know no other language, know no other country," Collins said.

The U.S. Border Patrol also has no record of Montes's initial arrest and, according to DHS, Montes didn't mention his DACA status when he was detained on Feb. 19.

I have a feeling he is going to be allowed to come back.

I sincerely hope they let him back. It would be a huge win for us.

He's not coming back.

(And not because of any of the inane reasons given on this thread)

DHS has full discretion and authority under current law to deport any and all persons without legal status. Period. Even DREAMERs are "low level priority" for deportation.

NICL, the organization suing the DHS, is doing so only to get information on why he was deported. Even they understand that their is nothing they can do beyond that to bring him back.

Nothing else is in the cards.

I think this is correct, but I feel so bad for this guy that my mind wants to rationalize a way for him to come back. Like maybe humanitarian parole based on his mental handicap in order for him to fight a deportation case here in the U.S., if he gets enough sympathy in the media and from senators maybe this is a possibility. It's better to spend years fighting a deportation case here in the U.S. than having it all be over. If a good attorney can fight a deportation case, he might be able to keep it alive through filing anything and everything, then appeal with BIA, then appeal with 9th circuit. His case would last years, maybe enough to outlast Trump and then get his case closed when PD comes back under a new president. I want to hope for an outcome like this, but with that attempted illegal re-entry it doesn't look good.
