Canceling AOS Before Marriage Interview

Dreamers,

As many of you know, I left my condo and I am now living with my parents. I am still considering on working on the marriage but at the moment I've never been this relieved and happy.

I've applied for AOS back in June and have not received my marriage interview. If we end up getting divorced, what are the steps to cancel the AOS?

Recall, I have been with her for 8 years and enough is enough.

Doesn't matter how long you have been with her. How long you have been married counts. Had you waited until your conditional residency, you would have been set. Consult a lawyer to ensure this does not mess up your DACA.

This is what I'm trying to figure out by asking here. We been married for almost a year.

You have to be married for more then 2 . Most likely nothin will happen to you . Your application will be consider abandoned and that's that . You might get some sort of removal order I'm no sure at all but your Daca status will save you nothing will change .

Been in somewhat similar process. It's going to take at least 7-9 months before you get your interview notice, knowing how slow they process, might take longer. If you don't show up for the interview, they will administratively close your case.

It will not affect your DACA status/application. Just note that your case file will be held up for your AOS, so if you are planning to file for DACA again, you will run into long delay for whichever center is processing your DACA for them to retrieve your file. I was shocked to find out in a digital age, they still use a single file that they pass around the departments/centers.

You can write to withdraw an I-485 but it will get denied anyways. Since you're on DACA (hopefully) you'll just end up falling on that so not like USCIS will serve you with an NTA or anything.

You should have both the I-130 and I-485 withdrawn. You should get your wife to withdraw the application. It does NOT look good having any application denied under your A-file. USCIS will scrutinize any further application for permanent residency if both are not withdrawn.

I did a quick google and it seems that it can be either me or her.

But you are right, I should withdraw it.
