If the court was going to announce later today that it is hearing the DACA case it would be kind of weird to put out the last argument calendar of the term right now

8:24 AM - 23 Feb 2018

but ...

It could just not hear the case and reverse it...

So if the SC declines, could Paxton or another AG just not try to get an injunction on DACA renewals while it goes through the courts? I know some people have been saying he'd sue by June if DACA continues, but it's possible he could it next week, no? What is there to stop him really if that's what Trump tells him to do?

People forget that the only reason Paxton was successful with the first lawsuit was because of the administrative procedures act not because DACA was ruled unconstitutional. Ironically it was that same APA procedure that brought us back DACA.

Even if Paxton were to sue DACA, it would take time for a judge to make the decision and even then who knows if he will be successful or not. Let’s also take in consideration that Kris Kobach once sued DACA on behalf of ICE and lost so this wouldn’t be our first lawsuit.
