Sen. Dean Heller (R-Nev.) said in a speech last week he believes Supreme Court Justice Anthony Kennedy will retire this summer, according to audio of the speech obtained by Politico.

“Kennedy is going to retire around sometime early summer,” Heller said in the speech, according to Politico. “Which I’m hoping will get our base a little motivated because right now they’re not very motivated. But I think a new Supreme Court justice will get them motivated.”
Heller is facing a tough GOP primary challenge ahead of the 2018 midterm elections from Las Vegas businessman Danny Tarkanian.

Kennedy’s possible retirement has been rumored for months.

This is very, very bad news. I hope he reconsiders and waits until after the next election.

Obama should have appointed Judge Garland in recess. It was the best decision for the country. He wimped out as he typically did.

Recess appointments only last until start of next congress, and can only start during recess.

Congress also tends to hold pro forma sessions solely so a president can't appoint.

Long enough to have decided the fate of 5 million people now being expelled from the U S.

Long enough to have established the legitimacy of Daca and Dapa.

It would have made all the difference in the world.

You do realize that republicans specifically kept pro-forma sessions so he wouldn't be able to make a recess appointment?

It’s a lot harde to justify removing a sitting judge even if recess appointment. Also it would’ve lasted a year and I doubt McConnel would have brought out the nuclear option during an election year.

I think you fail to understand the point I am trying to make.

YOU CAN'T MAKE A RECESS APPOINTMENT IF CONGRESS IS NOT IN RECESS. Congress is in recess when it says it is and any recess longer than 3 days requires both houses to agree on it.

Basically, the problem isn't that Obama wasn't able to sit someone on the bench but rather that no such recess was available because congress would keep pro forma sessions to keep itself from going into recess.
