New Member, IM i eligible?

Hey everyone, as others out here I was really hoping for the Dream Act to pass on, but after carefully going over it, I have some questions about whether i qualify for it or not, if anyone could let me know i would appreciate.

Unlike the vast majority of people interested in the Bill, I am a legal alien and always have been, I move to the US when i was 15, under an L2 visa, I graduated high school but i turned 21 and i eventually aged out of my dads L visa, since i was in collage i was advised to change my status to F1 and stay that way, today my parents and younger siblings have permanent residency but due to my age i was not able to jump in their application. I have now graduated college and Im living here under F1 OPT but it will soon expire, once that happens I have F idea what im going to do.

but back to the original question, do i qualify for the dream act? or is it only for people that are in the country illegally?

Unfortunately the Dream Act is only for people that are undocumented. I have spoken before about adding an amendment to the Dream Act for people in your situation (which happens to be the situation of my brother and sister as well) I will be doing an internship next semester where I will be working to pass the Dream Act and to add this new amendment to the Dream Act. I know we all undocumented deserve the Dream Act. But if I was more just I would say people like you and my siblings deserve it even more because you have never been undocumented.

BTW-When does your OPT end? I think the Dream Act will not pass until 2009. You're in a bad situation because I believe you are registered under SEVIS and maybe there would be a deportation order against you if you don't leave the country. Also I believe the information I gave you is correct but if you want you could contact NILC.org and ask them the same question. Try to speak to Mr. Josh Bernstein, he is one of the founders of the Dream Act.

You do qualify. I have spoken to several lawyers about this and you still qualify. There isn't a lawyer out there who would argue that you don't. It's easy to become undocumented anyways, all you have to do is violate the terms of your visa (get a job), notify USCIS and get yourself into removal proceedings and adjust via DREAM even if it were true that only undocumented students could adjust, which it's not.

I thought the bill specified the length of stay, and other pre requisites, but I don't remember anything about 'mandatory out of status' requirements. I thought it adjusts out of status/non temporary status to permanent status.

Edit: Damn ygaa beat me to the answer by 1 min.

MY OPT expires in November of this year, my situation does blow, which is why i am putting all my "money" on the dream act, so 2009 huh? how do you know it will take that long?
and if its only for illegal immigrants as someone else said, all i have to do is overstay.
IM not to worried about SEVIS, because im a Mexican citizen and i can allways claim that i left the country by land and my I94 was never collected you know what i mean?

I was really hoping for it to pass by the beginning of 08 maybe mid 08 but 2009 its a long wait!....
