Hearing now over. No ruling today. Judge Hanen wants further briefing on the following issue: If USCIS is using discretion in #DACA grants, did the program still violate the APA? Pro-DACA lawyers appeared to make headway convincing Hanen that DACA grants are discretionary.

The fact that he didn’t make an emergency ruling today is good news in my opinion. He may still rule against us, but this time around it won’t be as easy for him to do so.
