In a 117-page ruling, Judge Hanen decided that the DACA program will be maintained for now and left the door open to the plaintiffs to sue before a higher court such as the 5th Court of Appeals in New Orleans or the Supreme Court. of Justice.

The lawsuit against DACA was filed before the hanen judge by Texas Attorney General Ken Paxton and supported by several other states.

"This means that the dreamers will be able to continue renewing it," said immigration lawyer Naimeh Salem, although she clarified that no new requests will be accepted.

Hanen's decision took everyone by surprise, since in the past it was this conservative judge who denied the possibility that the parents of the dreamers had a benefit similar to theirs, such as being able to work legally in the country temporarily, through the DAPA program.

Judge Hanen stated in his ruling that although the DAPA program (which he denied a couple of years ago) and DACA "are basically identical", it is up to the Congress to decide whether to preserve this program or not in the long term.

Pro-immigrant organizations such as FIEL, United We Dream and Maldef (which was part of the lawsuit) celebrated the ruling adopted by Judge Hanen.

Texas Attorney General Ken Paxton said that today's decision by Judge Hanen implies that DAPA and DACA are indeed built on the same unconstitutional basis, so they will soon end up as DAPA did in 2014.

Paxton insisted that DACA is "a program of President Obama made to rewrite federal laws without going through Congress."

No. It just means that Hanen doesn’t want to end DACA yet. Waiting for SCOTUS nomination to go through and for DACA to be challenged there.

The contention about AP coming back ended when the DC case was withdrawn.

Pretty sure we established that this is how it was all going to go down. That's where it is likely to end once and for all, but obviously I really hope that by some miracle it doesn't.
