ICE arrests Dreamer at Work Because of Previous DUI Incident

Oscar Guerrero-Olivares was brought to the U.S. when he was a young child by his parents who were undocumented immigrants. He applied for and received DACA protections which made him a dreamer.

In November of 2017, Oscar was behind the wheel and intoxicated while driving on I-25 south of Colorado Springs when he crashed into a pole, his friend who was not wearing a seat belt was killed in the wreck.


"It's a horrible, tragic situation that keeps getting worse," said Oscar's defense attorney Dan Kay. "His best friend who died in his arms."

He served 121 days in jail and was released in March 2018. That's when Judge Bentley found it was unconstitutional to hold undocumented immigrants on ICE holds without probable cause.

Pleading down the 'vehicular homicide - DUI' case to 'vehicular homicide - reckless' the judge only sentenced him to six years probation and 600 hours of community service.


"It was a testament to his character that the Judge found that he was hard working and he was a good member of our society, of our community here in El Paso County; and that's why he decided not to put him in jail. Then five days later, he gets picked up by ICE and the tragedy continues," said Kay.

Just days after his released he got a job, hanging dry wall then at Poor Richard's resturant and began working in the restaurant.

His boss Richard Skorman wrote a letter to the judge at the Aurora detention center that said in part:

"Oscar comes to shifts early.
He works so hard.
Oscar's work ethic is outstanding.
Others were shocked as he was taken away.”

It seemed as if things were looking up, until January 16 when ICE agents arrested him at the restaurant.

"I think it's a targeted enforcement action. I think it is rare for them to do something like this," said Oscar's Immigration Attorney Alexander McShiras.

ICE's actions were a shock to Skorman and his attorneys, but on paper, Oscar is still a felon.

Keep that record clean guys, because no matter what the courts may say, on paper we are still criminals to ICE. We live in tough times were everything on our record matters.

People have been arrested and deported for less than this, let alone killing someone. He not longer qualifies for daca after this criminal incident. So he is apprehended in accordance with prosecutorial discretion for criminals.

Ice doesn’t care what a Jude says, they are their own arbitrary judges and that is scary as hell
